Twentieth Century Fox Film Corporation has agreed to pay $12.6 million to settle a class action lawsuit alleging it failed to properly account for and pay motion picture profit participants, including producers, writers, directors and actors, regarding certain types of revenue.
If you are a profit participant on a motion picture released by 20th Century Fox, you may be entitled to compensation from the class action settlement.
The 20th Century Fox class action lawsuit accused the movie company of failing to properly account for and pay motion picture profit participants in regard to home video revenue, electronic sell-through revenue, and video-on-demand revenue under profit participation contracts that don’t include clear provisions about the treatment of these types of revenues for the calculation of profit participation.
Home video revenue refers to the revenue derived from the sale of physical copies of motion pictures in the form of videocassettes, DVDs and Blu-Ray discs. Electronic sell-through revenue refers to the revenue derived from the sale of digital versions of motion pictures that are delivered to consumers via download purchases from iTunes, Amazon or other sites that sell movie downloads.
VOD revenue refers to revenue derived from digital streaming of motion pictures in which the consumer does not obtain permanent ownership of a copy of the motion picture. Netflix streaming is an example of video-on-demand.
Class Members who would like to opt out of or object to the 20th Century Fox settlement must do so no later than March 2, 2018.
Who’s Eligible
Class Members of the 20th Century Fox settlement include people and entities (or their successors-in-interest, assigns and heirs) who are parties to a “Class Profit Participation Contract,” which is defined in the class action settlement documents as a Profit Participation Contract using form definitions drafted by Fox before May 31, 1989, that do not state an express percentage of home revenue video and/or electronic sell-through revenue to use in calculating a profit participation.

The exact payout each Class Member receives will be based on a number of factors. See FAQ 9 for more information on how these payments will be calculated.
Proof of Purchase
Claimants must provide the name of the Fox motion picture, the name of the person who entered into the original profit participation agreement, the profit participant’s role (such as actor, writer, producer, etc.), and the claimant’s relationship to the profit participant.
