Golfland Entertainment Centers Inc. has agreed to pay $450,000 to settle a class action lawsuit alleging it failed to compensate some of its lifeguards for all hours worked, including overtime pay.
If you were a non-exempt lifeguard employed by Golfland in California between Sept. 14, 2012 and May 1, 2017, you may be entitled to compensation from the Golfland class action settlement.
According to plaintiff Jackson Stovall, Golfland violated California labor law by failing to compensate non-exempt lifeguards minimum wage for all hours worked, including overtime pay, for hours spent training. Stovall also claims Golfland failed to provide accurate payroll statements and maintain records as required by California law. Further, he claims Golfland failed to pay all wages due upon an employee’s termination or resignation.
Stovall sought unpaid wages and other civil penalties on behalf of other non-exempt, hourly lifeguards employed by Golfland in California.
Golfland denies the allegations and maintains that it paid its lifeguards for all hours worked, that it did not fail to reimburse them and that it did not violate California labor law. However, Golfland agreed to settle the wage and hour class action lawsuit to avoid the burden and expense of ongoing litigation. The Golfland class action settlement was preliminarily approved on Oct. 20, 2017.
The deadline to opt out of or object to the Golfland class action settlement is Dec. 14, 2017. The opt out form is available in the important documents section of the settlement website or by clicking here.
