Lunar Mining LLC aka Netflix has agreed to pay $225,000 to settle several class action lawsuits that alleged it violated the federal Fair Labor Standards Act and New York Labor Law by failing to pay parking production assistants correctly for all of the hours that they worked.

If you were a parking production assistant in New York between Feb. 23, 2010 and Jan. 10, 2017, you may be entitled to benefits from the Netflix class action settlement.

The Netflix class action lawsuits were filed by parking production assistants who claim they were owed compensation for hours they worked but were not paid for, including overtime pay. They claim that Lunar Mining violated the FLSA and New York Labor Law by failing to correctly pay the parking production assistants for all hours they worked.

The Fair Labor Standards Act and New York labor laws offer certain protections to employees, including the requirement that employers pay overtime to workers who work more than 40 hours in a workweek unless they meet specific exemptions. Employers are required to comply with federal and applicable state laws when calculating minimum wage and overtime payments.

Lunar Mining denies any wrongdoing but agreed to settle the Netflix unpaid overtime class action lawsuit to avoid the burden and expense of continued litigation.

The Netflix unpaid overtime class action settlement was preliminarily approved on Sept. 21, 2017.

If you would like to opt-out of the Netflix unpaid overtime settlement, you must do so no later than Dec. 29, 2017.

Who’s Eligible

Class Members of the Netflix unpaid overtime settlement include anyone who worked as parking production assistants on television, digital, web or film productions produced by Netflix (Lunar Mining) and filmed or taped in New York State from Feb. 23, 2010 through Jan. 10, 2017.

Potential Award

Varies.

Class action settlement payments will be distributed as a proportionate share of the settlement amount and will be based on a number of factors, including how many productions the Class Member worked on during the Class Period and for how long, and the total number of parking production assistants who participate in the settlement.

N/A. Class Members must submit proof of identity, such as a passport or driver’s license.
