BLOOMINGTON, MN/USA - JUNE 22, 2014: Staples office supply store exterior. Staples, Inc. sells supplies, office machines, promotional products, furniture, technology, and business services in stores and online.

A nearly $4 million settlement has been reached in a class action lawsuit alleging Staples Inc. misrepresented the terms and conditions of some of its Extended Services Plans.

If you purchased an Extended Services Plan from Staples in New York between Feb. 1, 2010 and Aug. 31, 2013, you may be entitled to compensation from the class action settlement.

According to the Staples class action lawsuit, which was filed by plaintiff Andrew Orlander in 2013, Staples failed to adequately disclose that its Extended Services Plans required to use any coverage available under the manufacturer’s warranty before obtaining coverage under the Extended Services Plan.

Orlander alleges Staples customers overpaid for the Extended Services Plans to the extent that they overlapped with the manufacturer’s warranty. The Staples class action lawsuit asserts claims for breach of contract, breach of express and implied warranties, unjust enrichment and violation of sections 348 and 350 of New York General Business Law.

Staples denies the allegations but agreed to settle the service plan class action lawsuit to avoid the burden and expense of ongoing litigation. The Staples class action settlement was preliminarily approved on Sept. 14, 2017.

Class Members who would like to object to or opt out of the Staples class action settlement must do so no later than Nov. 27, 2017.

Who’s Eligible

Class Members of the Staples settlement include anyone who purchased any Extended Services Plans from Staples in the state of New York from Feb. 1, 2010 to Aug. 31, 2013.

The Extended Services Plans included in the Staples class action settlement include product service plans that were administered and/or supported by Assurant and which applied to computers, digital readers, laptops, netbooks, tablets or any other technology products.

Potential Award

Varies, based on how many Class Members file claims and how much the Class Member paid for the Extended Services Plan. According to the Staples settlement website, Class Members are entitled to make a claim for an amount of at least 11 percent of the price paid for the protection plan.

Proof of Purchase

A Claim Form is not required if the Extended Services Plan was registered in the Class Member’s name. However, the Staples settlement website indicates the best way to receive a payment is to submit a Claim Form.

Proof of purchase is not required to submit a claim, but Class Members must provide purchase information on the Claim Form.
