Fax advertisement

Junk fax advertisements from Meadowbrook Insurance Group have led to a $1.5 million class action settlement now being distributed to Class Members.

Persons and businesses who received unsolicited fax advertisements from Meadowbrook Insurance Group as far back as April 2011 can qualify to receive payments under terms of this settlement.

This action was brought by plaintiff Town & Country Jewelers LLC in April 2015. Town & Country claims defendant Meadowbrook Insurance Group Inc. sent fax advertisements to Town & Country’s fax number without first getting their consent to receive such faxes.

Meadowbrook has not retained records of who received its advertisements. Based on available information, the parties have estimated that around 3,636 faxes were sent.

Town & Country says these faxes violated the federal Telephone Consumer Protection Act, or TCPA. The TCPA places certain prohibitions on using certain types of automated equipment to send advertisements via fax, phone, or SMS text message. Persons who receive prohibited communications may be able to bring a civil suit and seek up to $1,500 in statutory damages for each TCPA violation.

Meadowbrook Insurance Group continues to deny Town & Country’s allegations and maintains that its actions complied with applicable law at all times. The settlement does not require Meadowbrook to admit fault, and the court has made no decision as to liability.

Under terms of the settlement, Meadowbrook Insurance Group will put up a $1.5 million settlement fund. This fund will be divided among qualifying Class Members after first being used to pay a service award to the plaintiff, class counsel’s attorney fees, and the costs of administering the settlement. Payments to Class Members will be distributed on a pro rata basis.

Any funds remaining after that distribution will be donated to a nonprofit organization. The plaintiff has requested these funds go to the National Consumer Law Center and the Consumer Federation of America. The donated funds will be earmarked to support those organizations’ efforts to promote consumer protections related to telephone service.

Class Members must submit a Claim Form to receive payment. Forms may be submitted via mail or through the settlement website’s online form.

Class Members who want to object to the settlement’s terms or to have themselves excluded from the settlement must do so in writing by Oct. 31, 2017.

Who’s Eligible

The settlement Class covers all persons within the U.S. who are in Meadowbrook Insurance Group’s GoldMine customer database and who received any advertisement on their fax machine from the defendant or its agent between April 8, 2011 and June 21, 2017 (the date of preliminary settlement approval).

Potential Award

$500 (estimated)

While final payment amounts are yet to be determined, class counsel estimates that qualifying Class Members who submit valid and timely claims will receive payments between $300 and $500 each. Payments are capped at an absolute maximum of $1,500.
