A $4.9 million settlement has been reached in a class action lawsuit alleging Waste Industries LLC charged improper and excessive fuel surcharges and environmental fees.
If you paid fuel or environmental fees or surcharges to Waste Industries and/or any of its affiliated companies between March 3, 2011 and Sept. 15, 2017, you may be entitled to compensation from the class action settlement.
Plaintiff Wild Rides Internet Café LLC filed one class action lawsuit against Waste Industries in a North Carolina court and plaintiff Climate Masters Heating & Cooling LLC filed another Waste Industries class action lawsuit in a Georgia state court. The two Waste Industries class action lawsuits were consolidated in the Superior Court of Dougherty County in the State of Georgia.
The plaintiffs allege Waste Industries charged and collected unlawful and excessive “fuel surcharges” (also called “energy recovery fees”) and “environmental fees.” According to the class action lawsuits, Waste Industries breached its contracts with some of its customers and violated state statutory law.
Waste Industries denies that it did anything wrong, but it agreed to settle the environmental fee class action lawsuit to avoid the burden and expense of ongoing litigation.
The Waste Industries class action settlement was preliminarily approved on Aug. 9, 2017.
Class Members who would like to opt out of or object to the Waste Industries class action settlement must do so no later than Oct. 19, 2017.
Who’s Eligible
Class Members of the Waste Industries settlement include all individuals and entities in the United States which paid a fuel surcharge, “energy recovery fee,” or environmental fee at any time between March 3, 2011 (or other applicable statutory date) and Sept. 15, 2017.
Potential Award
To be determined.
The amount each claimant will receive depends on the fees they paid and the total number of Class Members who submit timely and valid claims.
