Collecto Inc. has agreed to pay $3.2 million to settle a class action lawsuit accusing it of violating the Telephone Consumer Protection Act by using automated telephone dialing systems to make debt collection calls to consumers’ cell phones.

Consumers who received a call from Collecto before July 1, 2014 may be eligible for a cash payment from the TCPA class action settlement.

If approved, this TCPA settlement will resolve two Collecto class action lawsuits that have been consolidated as In re: Collecto Inc. Telephone Consumer Protection Act (TCPA) Litigation.

The plaintiffs allege Collecto called consumers’ cell phones in effort to collect debts, and that these debt collection calls were made using an automatic telephone dialing system.

However, instead of calling the intended recipients, Collecto allegedly dialed wrong numbers and contacted individuals who did not have an agreement with the creditor for whom Collecto sought to collect the debt, which constitutes a violation of the TCPA, the Collecto class action lawsuit alleges.

The Telephone Consumer Protection Act is a federal law that restricts companies from making certain types of calls, such as those made using an automatic dialing system or prerecorded voice message, to consumers who did not provide their prior express consent to receive such calls.

Collecto denies the allegations in the TCPA class action lawsuit and denies that it used an automated dialer or prerecorded voice message to contact consumers without their prior consent. The company maintains it did not violate the TCPA but has agreed to settle the class action lawsuit to avoid the risk, cost, uncertainty and burden of ongoing litigation.

The Collecto TCPA class action lawsuit was preliminarily approved on Aug. 10, 2017.

Class Members who would like to opt out of or object to the Collecto TCPA settlement must do so no later than Nov. 27, 2017.

Who’s Eligible

Class Members of the Collecto TCPA settlement include U.S. residents who, between July 23, 2009 and June 30, 2014, received one or more calls on their cell phone made by Collecto using an automatic telephone dialing system, and who never had an agreement with the creditor for whom Collecto sought to collect.

Potential Award

Approximately $40 per call.

Payments will be distributed to Class Members on a pro rata basis. The actual amount each Class Member will receive depends on the total number of Class Members who file timely and valid claims.

Proof of Purchase

N/A. Claimants must certify that they are the assigned user of the cell phone that received the call or calls from Collecto during the Class Period and that they never had an agreement with the creditor for whom Collecto sought to collect the debt.
