Grace Healthcare settlement

An $8.4 million settlement has been reached in a class action lawsuit alleging Grace Healthcare understaffed certain nursing homes in Arkansas in violation of the residents’ contractual and statutory rights.

If you or a family member were a resident at Grace Healthcare of Benton and/or Grace Healthcare of Maumelle at any time between February 2007 and June 10, 2010, you may be eligible for benefits from the nursing home understaffing class action settlement.

Plaintiffs Marilyn Gillespie and Patsy Padgett filed the class action lawsuit in April 2012 against Benton Investments & Associates LLC d/b/a Grace Healthcare of Benton; Benton Property Investments LLC; Grace Healthcare LLC; Maumelle Investments and Associates LLC d/b/a Grace Healthcare of Maumelle; Maumelle Property Investment LLC and others over allegations the Grace Healthcare of Benton and Grace Healthcare of Maumelle nursing homes were chronically understaffed.

Plaintiff Deanne Hooker was added as a named plaintiff in a second amended complaint filed Nov. 21, 2013.

The Grace Healthcare class action lawsuit claimed the defendants violated the Arkansas Deceptive Trade Practices Act and the Residents’ Rights Act. The plaintiffs also allege the defendants breached the residents’ admission agreement.

The Grace Healthcare defendants deny the plaintiffs allegations of wrongdoing, fault or liability. However, they have agreed to settle the nursing home staffing class action lawsuit to avoid the risk of trial.

The Grace Healthcare class action lawsuit was preliminarily approved on May 25, 2017. The nursing home staffing settlement received final approval following a hearing on Sept. 5, 2017.

Who’s Eligible

Class Members of the nursing home staffing settlement include anyone who was a resident (or their family member) at the Grace Healthcare Nursing Homes in Benton and/or Maumelle, Arkansas between February 2007 and June 10, 2010.

Potential Award

$44 per day the resident spent in the Grace Healthcare nursing home.

Proof of Purchase

N/A. If you are filing on behalf of a resident pursuant to a power of attorney or as a court appointed guardian, you must provide a copy of the power of attorney or order appointing you as guardian.

If the resident is deceased, the claimant must submit the Status and Benefit form with proof that an estate exists or with a file marked copy of an affidavit.
