HACLA voucher payment reduction

A settlement has been proposed in a class action lawsuit alleging the Housing Authority of the City of Los Angeles (HACLA) and others reduced the voucher payment standard without providing adequate notice to Section 8 recipients, in violation of state and federal law.

If you were a HACLA Section 8 tenant between June 1, 2005 and Sept. 30, 2006, you may be entitled to payment from the Los Angeles Housing Authority class action settlement.

The proposed HACLA class action settlement provides for a payment of approximately $9 million to $9.4 million to eligible Class Members who file timely and valid Claim Forms.

According to the HACLA class action lawsuit, HACLA failed to provide the required one-year notice before they reduced housing benefits for Section 8 recipients. The plaintiffs also claim that the information provided to Section 8 recipients was not formal administrative notice and that the housing authority failed to notify recipients that their out-of-pocket rent payments would increase.

The plaintiffs allege that the notice provided to Section 8 recipients was so deficient in explaining the effect of the benefit reduction that it violated the constitutional right to due process of law and certain California state laws.

The defendants deny the allegations but agreed to settle the HACLA class action lawsuit to avoid the burden and expense of ongoing litigation. The HACLA class action settlement was preliminarily approved on July 29, 2017.

The deadline to object to or opt out of the HACLA class action settlement is Nov. 29, 2017.

Who’s Eligible

Injunctive Relief Class: Includes all HACLA Section 8 beneficiaries who received or may receive notices of a voucher payment standard decrease.

Damages Class: Includes anyone who was a HACLA voucher participant under Section 8 beginning April 2, 2004 and who paid a higher rent to their landlord than they otherwise would have paid if not for the reduced subsidy in effect from July 1, 2005 through April 30, 2007.

Potential Award

Members of the Damages Class may be eligible to receive reimbursement for up to 11 months that they overpaid rent. Some Class Members may be entitled to payments of several hundred dollars or more.

    I was a section 8 recipient at that time I also had spoke with a lawyer several times about the lawsuit but I never heard anything else and did not receive a payment. I believe that I am eligible. I know that I am because I spoke with the lawyers office several times so I’m wondering is there any way I can find out how I can get my check or if I check was made out to me for the settlement? If anyone can reply I’d appreciate it

    I was identity theft from my Hacla representative, at which I’m medical , my doctor had validated my medical forms etc. I was supposed to move a year ago. The staff was making unlawful entries until I had to get a restraining order , against a La Family housing. I over paid rent for six months. My apartment is inhabitant, and Norma Serena was well aware and still paid them , gave them permission to sign my name so they could get that big lump sum for the apartments that participated in allowing the vouchers to be accepted. She went as far as retrieving my bank information passing it around after my signing an affidavit regarding being identity theft from these same people in 2019

    My friend and I have a different perspective. Both of us are City of Los Angeles Section-8 voucher recipients and HACLA clients. We probably both qualify as plaintiffs, but neither one of us is going to submit a claim. Why not? Because we both view this as equivalent to setting our own houses on fire. The taxpayers have helped to pay both of our monthly rents for several years (both of us are severely disabled). Even if we were overcharged, neither one of us is interested in filing a claim. Making a claim on this one feels like someone gave me money and then I kicked them in response, instead of saying thank you.

      God Bless You Both for realizing and Acknowledging that, Juliette!! If More people were as Honest (and even A Little Concerned about Our Country/Tax Dollars, etc.) as You…we wouldn’t be in SUCH BAD SHAPE!!! Laziness and Apathy have Run Amuck in America!! So Sad. God Bless You, Ladies!! :-D

        America has spent tens of trillions on warfare (and “security”) over the last several decades, with over 10 trillion of that “missing” (cannot be accounted for in official records). But alas, all we hear from the nincompoops is about how “welfare” is bankrupting us.

        Once the corporatist entitlement mentality – especially profit without work through “investments” and “defense” contracts” – is overcome, we can focus on the little folks just trying to get by on less than $2000 per month.

      Do a web search for Stockholm Syndrome. You likely suffer from it.

      There is an American concept of equal protection of the laws. HCV/Section 8 recipients were denied this by the local administration. You are not “setting your own house on fire” by expecting to be treated justly.

      But it’s certainly up to you. You may want to vote Trump in 2020 if you feel you are being “noble” with things like this.

      I understand your decision. For myself, I would decided differently. My section 8 voucher from Redlands, was illegally terminated because the Housing Authority made me responsible for their part of the lease when I needed to move. I was very I’ll and already disabled. I was granted a portability to Sacramento. But apt. Management made a mistake in filing a 5 day notice when they did not receive section 8 part of rent. I had paid my portion and ready to move. Then I had to go to court to defend myself. I ended up paying my rent & housing authority portion of rent plus 805.00 for next months rent because I stayed for court. That is 1600.00 because housing authority did not pay their portion of my last months rent. I nearly had a break down from the fear and stress. I was in the right and had all my documents in order. The substitute judge ( attorney) still ruled against me ! Legal aid said this was a probability if substitute judge was sitting in court. I could not stay to file a disagreement and ask for another hearing because relocating the next day…Their went my moving fees and money for new rental. I felt it was a set up from the start. My eligibility worker was up to date on events but did not release their portion of my rent until after management had filed court papers. THEN when I tried to get my paperwork in Sacramento… I was told that Housing Authority had taken away my voucher because I had not fulfilled my obligations in Red lands. My financial obligations ! After I paid their portion of rent for 2 months….I paid my portion and theirs !.. Even tho I was not evicted…I still found that my records indicated I was evicted. Took forever to find housing. For myself and my 15 year old grandson..I was his guardian for years…I was very I’ll and he was traumatized and terrified…Devastating to both of us. I will not recover from that experience. It took me years to save money to move. If I was healthier believe I would have sued..They knew how I’ll I was and probably knew I was not able to go thru that process. Too busy trying to find a place to sleep…Horrible.

    HACLA are Bunch of SCUMBAGS! WHAT A SAD JOKE! Do your job right the first time you IDIOTS! That place should be shut down, investigated and procescuted. So pathetically sad. One more reason Los Angeles is A shitty place to live!
