A settlement has been reached in a class action lawsuit involving allegations Encompass Insurance of America and Encompass Indemnity Company failed to adequately pay for the loss in value for certain vehicles that sustained damage that could not be fully repaired.
If you had an auto insurance policy in Washington that was issued by Encompass, and you received compensation to cover damage to your vehicle after July 28, 2009, you may be entitled to a cash payment from the Encompass class action settlement.
According to the Encompass class action lawsuit, the Encompass defendants failed to offer adequate compensation for diminished value of vehicles that sustained damage to their structural systems and bodies when the vehicles were unable to be fully repaired to their pre-accident condition. Plaintiff Alec Zarelli alleges this failure to pay breaches the Encompass defendants’ automobile insurance contracts.
The Encompass defendants deny the allegations and contend they paid the full and appropriate amounts for vehicles’ diminished value. However, they agreed to pay $242,400 to settle the auto insurance class action lawsuit and avoid the burden and expense of trial.
The Encompass class action settlement will offer compensation to consumers who had Encompass uninsured motorist property damage coverage under an insurance policy issued in Washington and who did not receive payment, or who did not receive adequate payment, for the diminished value of vehicles that sustained damage to their structural systems and bodies that could not be repaired to the pre-accident condition.
The Encompass insurance class action lawsuit was preliminarily approved on March 10, 2017.
Who’s Eligible
Class Members of the Encompass diminished value settlement include anyone for whom Encompass paid to have their insured vehicle repaired under the uninsured motorist property damage provision of an Encompass policy issued in Washington, and:
- The repair estimate on the vehicle totaled at least $1,000; and
- The vehicle was no more than six years old and had less than 90,000 miles on it at the time of the accident; and
- The vehicle suffered structural damage, deformed sheet metal, and/or required paint or body work.
Potential Award
Varies, depending on the Class Member’s vehicle repair costs and the total number of claims filed.
It is estimated that the average payment will be in the range of several hundred dollars per Class Member.

Class Members are asked to provide their 12-digit Claim ID, which was listed on the top left corner of the notice that was mailed.
