A settlement has been reached in a class action lawsuit alleging HealthPort Technologies LLC (now known as CIOX Technologies LLC) charged an excessive fee to some consumers who paid for copies of their medical records.

If you were charged by HealthPort/CIOX for copies of medical records, you may be entitled to payment from the class action settlement.

According to the HealthPort class action lawsuit, which was filed in August 2012, HealthPort/CIOX charged more than 25 cents per page after the first 25 pages for copies of medical records. The plaintiff asserted that these charges were excessive and violated certain Florida Administrative Code rules.

The HealthPort class action lawsuit asserts HealthPort/CIOX owes restitution and interest to all affected Class Members.

HealthPort/CIOX denies the allegations but agreed to settle the medical records fee class action lawsuit to avoid the burden and expense of ongoing litigation.

Under the terms of the medical records fee class action settlement, HealthPort/CIOX has not only agreed to provide monetary compensation to consumers who were allegedly overcharged for copies of their medical records, the company has also agreed to modify its business practices related to medical records requests.

The HealthPort medical records fee class action settlement was preliminarily approved on May 10, 2017.

Who’s Eligible

Class Members of the CIOX settlement include patients of physicians or a practice licensed under Florida law and who, since March 9, 2009, made a request through a legal representative to the physician’s office for copies of your medical records, and you were billed by HealthPort/CIOX at charges that exceeded 25 cents per page after the first 25 pages, and you paid for those charges.

Potential Award

A full refund of the allegedly excessive medical records fees, plus interest at 4.78 percent per annum.

The refund amount you are estimated to receive is calculated for you on the Claim Form that was provided to you with the notice of the HealthPort/CIOX class action settlement.

Proof of Purchase

Class Members must provide the Notice ID that was provided on the notice of the settlement they received.
