A settlement has been reached in a class action lawsuit alleging certain River Metals Recycling locations took vehicles without the owners’ consent.
If you were the owner of a motor vehicle that was taken without your consent and transferred or sold to any of River Metals Recycling locations in Kentucky between Jan. 23, 2011 and June 29, 2017, you may be entitled to benefits from the class action settlement.
If approved, this River Metals Recycling settlement would resolve a class action lawsuit that alleged RMR locations in Kentucky purchased vehicles without the consent or authorization from the vehicle owners. The plaintiffs claim these vehicle purchases violated Kentucky law.
River Metals Recycling denies the allegations and maintains it complied with all applicable laws. However, it has agreed to settle the class action lawsuit to avoid the burden and expense of ongoing litigation.
Under the terms of the proposed class action settlement, River Metals Recycling has agreed to pay qualifying Class Members up to the average of the “Fair” and “Good” value for the vehicle as listed in the Kelley Blue Book, or the average cost paid for scrap material by RMR based on the estimated vehicle weight of 3,000 pounds.
The River Metals Recycling class action settlement was preliminarily approved on June 29, 2017.
Class Members who would like to opt out of or object to the River Metals Recycling settlement must do so no later than Oct. 17, 2017.
Who’s Eligible
Class Members of the River Metals Recycling settlement include anyone who, between Jan. 23, 2011 and June 29, 2017, was the owner of a motor vehicle that was stolen or taken without your consent or authorization and was transferred or sold to any of River Metals Recycling’s Kentucky locations without your consent or authorization.
The transfer of the vehicle to River Metals Recycling may have occurred directly from the person who took your vehicle or it may have occurred when another business received and sold scrap metal to River Metals Recycling.
Potential Award
Varies. If your vehicle was sold directly to River Metals Recycling, you may be eligible to receive a settlement award up to a full estimated value of the vehicle. If your vehicle was first sold to another vendor before being sold to River Metals Recycling, you will receive a settlement award based on the estimated vehicle weight and average metal purchase price.
Proof of Purchase
Class Members must provide information about their vehicle such as the make, model and year. Although it is not required, the settlement administrator recommends attaching documentation showing proof of ownership of the vehicle.
