A settlement has been proposed in a class action lawsuit alleging Uptown Communications & Electric Inc. violated the Fair Labor Standards Act and New York Labor Law by failing to pay overtime to some employees.

If you were employed by Uptown Communications & Electric as a cable installer/technician at any time between Aug. 6, 2011 and June 26, 2017, you may be entitled to a cash payment from the class action settlement.

Plaintiffs Dunbar Davis and Regan Laing filed the Uptown Communications class action lawsuit on behalf of themselves and a proposed Class of other cable installers/technicians, asserting claims for unpaid overtime under the FLSA and New York Labor Law.

According to the unpaid overtime class action lawsuit, Uptown Communications did not pay cable installers/technicians overtime pay for the hours over 40 hours worked in a work week.

The defendants deny any wrongdoing but agreed to settle the Uptown Communications class action lawsuit to avoid the burden and expense of ongoing litigation. The company will pay $670,000 to eligible Class Members who file a timely and valid Claim Form.

Class Members who would like to opt out of or object to the Uptown Communications unpaid overtime settlement must do so no later than Sept. 29, 2017.

Who’s Eligible

Class Members include anyone who worked for Uptown Communications as a cable installer/technician at any time between Aug. 6. 2011 and June 26, 2017.

Potential Award

Varies, depending on how long the Class Member worked for Uptown Communications during the Class Period and the total number of weeks worked by all Class Members.
