A recent privacy rights class action settlement entitles customers of certain Pizza Hut locations in California to vouchers that are good towards future purchases.
This Pizza Hut class action lawsuit was filed by plaintiff Jessica Manner in February 2015. Manner claims defendant Summit Pizza West, which operates more than 50 Pizza Hut restaurants in California, has been violating California state law designed to protect consumers from identity theft and credit card fraud.
California law prohibits businesses from requesting personal identification information from a patron, such as their address or telephone number, then recording that information on the credit card transaction form.
Manner alleges the defendant’s Pizza Hut restaurants have been doing exactly that. She says that in July 2014, she bought a take-out pizza from a San Diego Pizza Hut. During that transaction, the cashier asked her for her telephone number, then recorded it using the electronic cash register.
After an initial round of motions, discovery, and mediation sessions, the parties entered into the current Pizza Hut class action settlement. Terms of the settlement require Summit Pizza West to distribute vouchers to each qualifying Class Member who submits a valid and timely claim.
These vouchers can be redeemed for food or drinks at one of the defendant’s Pizza Hut locations in California. Qualifying locations are listed on the settlement administrator’s website. No minimum purchase is required to redeem a voucher, but only one voucher may be redeemed in a single transaction.
Summit Pizza West continues to deny Manner’s allegations but has entered into the proposed settlement in the interest of avoiding the expense and risk involved in continuing litigation.
Who’s Eligible
Class Members include all persons from whom Summit Pizza West requested personal identification information in conjunction with a carry-out purchase from one of the company’s Pizza Hut locations in California between Feb. 20, 2014 and March 13, 2015.
Potential Award
$20.97 in Vouchers
Qualifying Class Members who submit valid and timely claims will receive three vouchers worth $6.99 each, for a total of $20.97, good towards the purchase of food or drinks at one of the defendant’s Pizza Hut locations in California.
Proof of Purchase
Claimants who did not receive a Claim ID and an Access Code on a class notice received in the mail must submit their current contact information and declare under penalty of perjury that they made a qualifying purchase at a qualifying Pizza Hut location in California. The san diego pizzahuts are refusing to honor these vouchers by coming up with all sorts of excuses and increasing the prices of your order!!!!
i used all three of mine in the town of FallBrook down south,, and they excepted all three with no problems at all, you have to do each transaction separate.
Well, I received coupons to redeem one at a time, but I live in Northern Calilfornia, and I have to use them only in San Diego… lol!!! Do I have to go all the way down, 4 times to use them?
