Settlements have been reached in several class action lawsuits filed by certain purchasers of natural gas who allege the defendants engaged in an unlawful conspiracy to manipulate the prices of natural gas between Jan. 1, 2000 and Oct. 31, 2002.
If you are a commercial or industrial entity that purchased natural gas in Kansas, Missouri or Wisconsin, your rights may be affected by these class action settlements.
The plaintiffs allege the defendants and co-conspirators engaged in an unlawful agreement to manipulate the prices of natural gas from Jan. 1, 2000 through Oct. 31, 2002. As a result of this alleged antitrust conspiracy, they paid more for natural gas than they would have if the defendants had not engaged in the conspiracy, the natural gas antitrust class action lawsuit alleges.
Class action settlements have reportedly been reached with the following defendants: American Electric Power Company Inc., AEP Energy Services Inc., Coral Energy Resources LP n/k/a Shell Energy North America (US) LP, Duke Energy Carolinas LLC f/k/a Duke Energy Corporation, Duke Energy Trading and Marketing LLC, ONEOK Inc., ONEOK Energy Services Company LP f/k/a ONEOK Energy Marketing & Trading Company LP, and Kansas Gas Marketing Company.
The settling defendants deny the allegations set forth in the natural gas antitrust class action lawsuit but agreed to settle the litigation to avoid the burden, risk and expense of trial.
The natural gas antitrust class action settlements were preliminarily approved on Jan. 26, 2017. A judge granted final approval to the natural gas settlements on May 17, 2017.
Litigation is still pending among a group of defendants who have not agreed to settle the natural gas antitrust class action lawsuits. Additional money may be available in the future if future settlements are reached or as a result of a trial. However, there is no guarantee that additional money will be available.
NOTE: A second group of settlements that affects natural gas purchasers in Kansas and Missouri has also been proposed. However, the claim filing period will not be open until it receives final approval. The final approval hearing took place on Aug. 9, 2017. Top Class Actions will post an update as soon as the settlement administrator begins accepting claims for those class action settlements.
Who’s Eligible
You may be eligible for benefits from these class action settlements if you are an industrial or commercial direct purchaser of natural gas for your own use or consumption between Jan. 1, 2000 and Oct. 31, 2002, and the gas was used or consumed by you in Kansas, Missouri or Wisconsin.
Potential Award
Varies. Settlement funds will be distributed pro rata based on the volume of natural gas each claimant purchased in proportion to the total number of Claim Forms filed.
Proof of Purchase
Class Members are asked to provide documentation or other evidence indicating the volume of natural gas they purchased during the Class Period.
