Benefits are now available for motorists insured under a Travelers policy issued in Washington state, thanks to a recent car insurance class action settlement.
Plaintiff Daniel Dawsey initiated this Travelers class action lawsuit in February 2015. Dawsey says defendant The Travelers Indemnity Company has been failing to pay all the benefits it should pay under its Washington state automobile insurance policies.
Travelers allegedly failed to fully compensate for structural and body damage that prevented the damaged vehicle from being fully repaired to its pre-accident condition, causing a permanent reduction in the vehicles’ value. According to Dawsey, this damage should have been covered under the Travelers policies’ uninsured motorist property damage coverage, or UIM PD coverage.
By denying coverage or granting inadequate coverage for this type of damage, Dawsey argues, Travelers is liable for breaching its policies and for engaging in an unfair business practice.
Travelers continues to deny Dawsey’s claims but has agreed to this car insurance class action settlement in the interest of avoiding the expense and risk associated with further litigation.
Under terms of the settlement, Travelers will create a settlement fund totaling $760,000. After being used to cover court costs, attorneys’ fees, and incentive awards for the class representative, this fund will be distributed among Class Members who file valid and timely claims.
Claimants may file one claim for each qualifying accident. Claimants must include the Claim ID shown in the settlement notice they received. Claims may be filed online or by mail.
Who’s Eligible
The settlement Class covers all persons insured by a defendant-issued personal or commercial lines automobile insurance policy issued in Washington state who were involved in a vehicle accident between Feb. 23, 2009 and April 27, 2017 in which the vehicle sustained damage covered under the policy’s UIM PD coverage, and who also meet the following conditions:
- Repair estimates for the damage came to at least $1,000;
- The vehicle was no more than six years old and had no more than 90,000 miles on it at the time of the accident; and
- Damage to the vehicle included either structural (frame) damage, deformed sheet metal, or a need for body or paint work.
Potential Award
Varies.
Actual payment amounts will depend in part on the number of valid and timely claims received. The settlement administrator estimates qualifying Class Members will be entitled to several hundred dollars each, depending on how much payment the Class Member has already received for diminished value.
Proof of Purchase
Each claimant will need to provide the Claim ID number that appears on the notice they received. The settlement administrator does not request any other supporting documentation besides the information requested on the Claim Form.
