A settlement has been proposed in a class action lawsuit alleging U.S. Gas & Electric Inc., Energy Services Providers Inc. and Pennsylvania Gas & Electric deceived customers by imposing significant and unexpected rate increases on their electric services.
If you purchased electric service from Pennsylvania Gas & Electric at any time through Feb. 13, 2017, you may be entitled to a payment from the rate increase class action settlement.
Plaintiff Thomas Sobiech initially filed the Pennsylvania Gas & Electric class action lawsuit on July 25, 2014. Sobiech alleged that the defendants’ acts and omissions regarding their energy supply activities constituted a breach of contract and a breach of the covenant of good faith and fair dealing. He sought declaratory relief and damages.
The defendants deny all of the allegations and sought to dismiss the class action lawsuit, but their motions to dismiss were denied.
The parties ultimately agreed to a class action settlement to avoid the burden and expense of trial.
The Pennsylvania Gas & Electric class action settlement was preliminarily approved on June 7, 2017.
Class Members who would like to exclude themselves from or object to the Pennsylvania Gas & Electric settlement must do so no later than Oct. 9, 2017.
Who’s Eligible
Class Members include anyone in Pennsylvania who purchased electricity from U.S. Gas & Electric, Energy Services Providers Inc. and Pennsylvania Gas & Electric at any time up to and including Feb. 13, 2017.
Potential Award
Varies, depending on the total number of valid claims received.
Each eligible claimant will receive a pro rata share of the $1.25 million class action settlement fund.

Class Members are asked to provide a Claim Number from the mailed notice about the settlement and their account number, if available. Claimants must declare under the penalty of perjury that all of the information provided in the Claim Form is true and correct, and that they did not previously receive a refund payment from the defendants.

I’m not sure if this lawsuit pertains to an elderly person in my area (94) who does not use internet, and this is my first time seeing this. I only recently learned of her predicament regarding her electric bill. Please advise. Has the deadline to file been extended? Is there anything I can do to possibly help her?

You may not get a response unless more information is required for your claim. Settlements can take several months from the final approval to pay out, due to the time it takes to review and process claims. You can always contact the settlement administrator to inquire about the status of your claim: https://www.paenergysettlement.com/Home/ContactUs
