A settlement has been reached in a class action lawsuit alleging Greystar Management Services LP and Riverstone Residential Group violated the Texas Water Code and Texas Administrative Code by billing residents at certain apartment complexes improper sewer and water fees.
If you are a current or former residential tenant at certain Greystar properties and you were charged and paid the allegedly improper fees or surcharges for water and wastewater, you may be entitled to payment from the Greystar class action settlement.
The full list of defendants named in the Greystar class action settlement include: Greystar Management Services LP, GREP General Partner LLC, Greystar Real Estate Partners LLC and its subsidiary formerly known as Riverstone Residential Group, SVF Cantebrea LP d/b/a Alara Cantebrea Crossing, and SVF Cantebrea Corporation d/b/a SVF Cantebrea GP Corporation.
Plaintiff Justin Regehr filed the Greystar class action lawsuit on June 11, 2015, claiming he was improperly charged a utility connection, activation, new account fee or a surcharge for water and wastewater. Specifically, Regehr says he was charged a $12.50 Utility Connection Fee, which he says is “simply a made up fee.” He claims his lease did not authorize the assessment of this fee, and that the fee is illegal under Texas law.
The defendants deny the allegations and maintain they properly assessed and collected the sewer and water fees. However, they have agreed to settle the Texas water utility class action lawsuit to avoid the burden and expense of further litigation.
Under the terms of the Greystar water utility settlement, the defendants will pay $2.7 million, which will be used to pay qualified Class Members, costs of notice and administration, attorneys’ fees, and other awards and costs that are approved by the court.
Class Members who would like to exclude themselves from or object to the Greystar water utility settlement must do so no later than Aug. 18, 2017.
Who’s Eligible
Class Members of the Greystar water utility settlement include all current and former residential tenants at certain properties who, since June 2011, were residential tenants at a property in which Greystar served as owner, landlord or manager, and/or SFV Cantebrea was the legal titleholder, and who were charged and paid the fees at dispute in the Greystar class action lawsuit.
A list of the properties covered by the Greystar class action settlement are in Exhibit E within the settlement agreement.
Potential Award
It is estimated that payments from the Greystar settlement will be approximately $14.50 per household.

I am living at a property managed by Greystar in the past 3 years I have been questioning the billing process of my gas and water and the property changes manager’s so often that I never get a answer and for over a year I have been owing a fee for my utilities that is not right And realy can not be explained now after a year I get a notice vacate

I’m currently live in Churchill on the Park. I have been living here for over two years and have been paying these fees. I didn’t know about this class action until a friend told me. Do I need to sign up to receive the refund? Is it too late? Also, is Greystar allowed to continue to double charge their tenants with water and sewer fees?

I found this totally by accident online with all these lawsuits and bad reviews from Greystar Management. I am having difficulty with scam leasing information given to me back in 2018, to occupy a Unit, and left the property for so many serious reasons, including approved invasion of privacy by Management and perhaps, the company, non-communication, dog poop, poor to none maintenance, and excessive fees for which I was never informed of prior to renting the unit. I had to move-out because of criminal activity in 2019, and non-communication from Management with concern for cameras in smoke detectors, and someone entering my office each time I would leave the premises. I am now receiving bills from a Washington office with fees that have been added that are false charges. This company I now see has a pattern of charging tenants and it has been kept very quiet. They continue to be in business and rent these units. No one should ever rent from Greystar because something is very wrong with a company that has and is perhaps, being sued and they continue in the same manager. This young lady in receivables has sent me an email for which I replied to and now, her no-reply Email states “she is out of office until January 2020. Someone need to stop this theft of non-services where this company is being paid for services that tenants do not receive. I never had trash pickup and was never told it was available upon leasing, be it a charge, or non-charge. $25.00 fee attached to a separate billing that includes so much other false charges. They have threatened to report if not paid. I pay what I owe, and these charges are false and I want to see that these charges are stopped by this crooked company. I eagerly will be a part of this law suit, or I may need to file my very own.
