Starion Energy class action lawsuit

Starion Energy Inc. and related entities Starion Energy NY Inc. and Starion Energy PA Inc. have agreed to settle a class action lawsuit challenging the electricity supply rates charged to their variable rate customers.

If you were a customer of Starion Energy’s variable rate electricity supply services through May 24, 2017, you may be entitled to a cash payment from the Starion Energy class action settlement.

The Starion Energy class action lawsuit was filed in January 2017 by plaintiff Lydia Gruber, who alleges Starion falsely claimed that its variable rate for electricity supply services would reflect the cost of electricity “obtained from all sources” by Starion.

Gruber says that this contractual representation suggests that Starion’s price for variable rate electricity would fluctuate based on the cost of procuring the electricity, meaning the price would increase and decrease according to the market rates.

However, Starion allegedly failed to decrease its variable rate when the wholesale market rates decreased, and routinely charged its variable rate customers as much as five times the market rate, according to the Starion Energy class action lawsuit.

“Through this scheme, Starion subjects consumers to consistent and unlawful ‘heads I win, tails you lose’ pricing,” Gruber alleges in the Starion Energy class action lawsuit.

Starion Energy denies the allegations and maintains it did nothing wrong. However, it has agreed to settle the variable rate electricity supply class action lawsuit to avoid the burden and expense of ongoing litigation.

The Starion Energy class action settlement was preliminarily approved on May 24, 2017.

Class Members who wish to opt out of or object to the Starion Energy settlement must do so no later than Oct. 23, 2017.

Who’s Eligible

Class Members of the Starion Energy settlement include all individual residential and small business consumers enrolled in a Starion variable rate electric plan in connection with a property located in Connecticut, the District of Columbia, Delaware, Illinois, Maryland, Massachusetts, New Jersey, New York, Ohio or Pennsylvania from 2010 through May 24, 2017.

Potential Award

Varies.

Claimants will be eligible to receive a share of the settlement fund based on the power they used in each “Eligible Month,” which will be based upon a calculation of the months in which Starion’s electricity sales exceeded its total costs plus margin. Damages will be determined on an individual basis to determine how much payment each Class Member will receive.

NOTE: Claimants whose calculated loss totals are less than $3 will not receive payment from the Starion Energy class action settlement.

Proof of Purchase

Class Members must provide the electric utility account number for the account that was enrolled in Starion Energy’s variable rate electricity supply services during the Class Period.

    How many of you even knew about the law suit to begin with? Stop whining about getting money and be happy someone was looking out for you at all. I received 66.71 for just signing up and going to buy my grandsons stuff since I never expected the money to start with.

    Same here. I look at the Lawyers fees in this suit. I bet they got paid for there services. Meantime we are the ones who paid the price for there price gouging ! Little guys never win !????? Just Sayin
