A settlement has been reached in a class action lawsuit alleging Sears failed to redeem gift cards upon a customer’s request when the remaining balance on the gift card was less than $10.
If you are a California consumer who possessed a Sears gift card with a balance of less than $10, but you disposed of it between Jan. 12, 2013 and June 21, 2017 after you were informed by a California Sears employee that it could not be redeemed for cash, you may be entitled to benefits from the Sears gift card class action settlement.
Plaintiff Michael Saunders filed the California gift card class action lawsuit against Sears on Jan. 12, 2017, accusing the retailer of violating California’s gift card law by failing to redeem Sears gift cards with a balance of less than $10 for cash upon a customer’s request.
Sears denies any wrongdoing but agreed to settle the California gift card class action lawsuit to avoid the burden and expense of ongoing litigation.
The Sears gift card class action settlement was preliminarily approved on June 22, 2017.
In addition to providing eligible Class Members with Sears gift cards that can be redeemed for cash, Sears has also agreed to comply with California gift card law in all of its California Sears stores and will review and update its policies to ensure that all California Sears employees are aware that they must allow customers to redeem gift cards for cash if the gift card balance is less than $10.
Class Members who would like to opt out or object to the Sears gift card class action settlement must do so no later than Sept. 19, 2017.
Who’s Eligible
Class Members of the Sears gift card settlement include California consumers who possessed a Sears gift card with a balance of less than $10 but disposed of it during the period Jan. 12, 2013 through June 21, 2017 after being informed by a California Sears employee that the gift card could not be redeemed for cash.
Potential Award
$9.99 Sears gift card.
The Sears gift card can be used or redeemed for cash at any Sears location in California.
NOTE: Under the terms of this California gift card settlement, Sears has agreed to make available up to 1,000 gift cards that must be claimed within 12 months of the Effective Date of the Sears class action settlement.
Proof of Purchase
N/A. Class Members must assert under the penalty of perjury that they possessed a Sears gift card with a balance of less than $10 but disposed of it between Jan. 12, 2013 and June 21, 2017 after they were informed by a California Sears employee that it could not be redeemed for cash.
Claim Form Deadline
To Be Determined.
The Claim Form deadline will occur either after 1,000 Class Members submit a valid claim or within 12 months after the Sears gift card settlement date, whichever is earlier. Top Class Actions will update this page as soon as we learn that the Class Counsel is no longer accepting Claim Forms.
UPDATE: On July 18, 2017, more than 1,000 claims were submitted for the California Sears gift card class action settlement. The settlement administrator is in the process of making sure the claims are valid. If they find that less than 1,000 submitted claims were valid, the settlement will reopen.
