Telebrands has agreed to settle a class action lawsuit stemming over allegations that the company made false promises when advertising its Aero Knife.

Plaintiff Amy Rehak filed the Aero Knife class action lawsuit on behalf of herself and all other Missouri residents who purchased the “As Seen On TV” knife.

Telebrands was accused of engaging in practices that “constitute deception, fraud, false pretense, false promise, misrepresentation, unfair practice or the concealment, suppression or commission of material facts in connection with the sale and/or advertisement of the Aero Knife.”

Under the terms of the class action settlement, Telebrands is offering Missouri residents who purchased the Aero Knife a full refund if they return the product to the Claims Administrator. Missouri residents who bought an Aero Knife but do not return the product are still eligible for a $5 cash award.

In addition to offering a full refund to consumers who return the Aero Knife, Telebrands has also agreed to stop promoting the product as a “$50 knife for $10.”

Rehak will receive an incentive award for bringing the class action lawsuit in the amount of $10,000 and Class Counsel is expected to receive $200,000 to cover legal expenses.

The Aero Knife class action settlement was preliminarily approved on March 8, 2017. The deadline to opt out of the terms of the settlement or object passed on June 6, 2017.

Who’s Eligible

Class Members include all Missouri consumers who bought an Aero Knife for personal use and have not previously received a refund for the product.

Potential Award

Full Refund or $5.

  • Consumers who want a full refund for their Aero Knife must return the product to the Claims Administrator along with their Claim Form. Free shipping is being offered to those Class Members.
  • Those who want to keep their Aero Knife are still able to file a claim for the class action settlement and will receive a payment of $5.
Proof of Purchase

None is required, however, to receive the full refund of the actual purchase price, settlement Class Members must return the Aero Knife to the Claims Administrator along with their Claim Form. Those seeking the $5 cash payout must submit a Claim Form no later than July 12, 2017 and attest under penalty of perjury that all the information submitted on the form is true.

    Got a denial letter today stating that “Your Claim has been rejected because this Settlement provides benefits to only Missouri residents who purchased an Aeroknife for personal use and not for resale” Replied back to them stating I had move and got a response today stating ” Please provide proof of your Missouri residence. Acceptable proof of residence includes: Utility Bill, Phone Bill, Mortgage Statement, Property Tax Bill and/or a Bank Statement. Please check that the address and name are visible before sending.” So basically you have to own a home to qualify for this as a person renting wouldn’t have three of these things and I use a pre paid cell phone and ordering my bank statement would cost $5 for a $5 claim. It’s a $5 class action lawsuit why all these requirements?

      Don’t have any utility bills in my name even the place I live I still don’t. Obviously you are a residence just because you don’t have any bills in your name means nothing because you can live with family or renting a room.

      I so totally agree with that! I’ll let them keep my $5. I tossed the knife a while back. Sorry but they can keep the $5. Something doesn’t sit right with that.
