A $1.8 million settlement has been reached in a class action lawsuit alleging Zale Delaware Inc. d/b/a Zale Corporation violated certain federal and California wage and hours laws.
If you were employed by Zale Corporation as a non-exempt employee in California during the period July 3, 2009 through April 18, 2017, you may be entitled to a cash payment from this wage and hour class action settlement.
The Zales class action lawsuit alleges that some non-exempt employees were not paid the wages they were owed upon termination from employment, they were not provided meal and rest periods as required by California law, they were not paid for overtime, and that they were not provided paycheck statements with all of the information required under California wage and hour law.
Plaintiff Naomi Tapia, who previously worked as a jewelry consultant for Zales, alleges these actions constituted violations of the federal Fair Labor Standards Act and California labor law. She initially filed the Zales class action lawsuit in July 2013.
Zale denies the allegations and maintains it did not violate the law. However, the company has agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Zales class action settlement was preliminarily approved on April 18, 2017.
The deadline to opt out of the Zales class action settlement is June 22, 2017.
Who’s Eligible
Class Members of the wage and hour settlement include all current and former non-exempt Zale employees who worked in California between July 3, 2009 and April 18, 2017.
Potential Award
The average payment is estimated to be $500.
Class Members will receive a pro rata share of the available settlement money. The amount will be based on the total number of weeks worked.
According to the Zale settlement notice, a certain monetary value will be assigned to each week Class Members worked during the Class Period. An individual Class Member’s payment will be determined by multiplying this dollar value by the total number of weeks the Class Member worked.
