Discover Home Loans TCPA settlement

A judge has preliminarily approved a $5 million class action settlement over allegations that Discover Financial Services and Discover Home Loans Inc. violated the Telephone Consumer Protection Act by making telemarketing calls to consumers who did not consent to receiving such calls.

If you received telemarketing calls from Discover Home Loans between June 1, 2012 and July 31, 2015, you may be entitled to a cash payment from the TCPA class action settlement.

According to the class action lawsuit, Discover Financial Services is a direct banking and payment service that performs its mortgage refinance business through its subsidiary, Discover Home Loans.

The plaintiff asserts that part of Discover’s strategy for increasing the number of home loan customers is to use an automatic telephone dialing system and/or automated or prerecorded messages to make telemarketing phone calls to consumers. These non-emergency calls were allegedly made without the consent of consumers and violated the TCPA.

The Telephone Consumer Protection Act was enacted in Congress in 1991 as a response to an increasing number of complaints from consumers about certain telemarketing practices. Under the TCPA, it is unlawful for any business to make a non-emergency call using an automatic telephone dialing system or an artificial or prerecorded voice to consumers who did not provide prior express consent to receive such calls.

It is also unlawful under the TCPA for a business to make more than one call in a 12-month period to any number that has been registered on the company’s do not call list or the National Do Not Call Registry.

The Discover defendants deny any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Discover Home Loans class action lawsuit was preliminarily approved on Jan. 20, 2017.

The deadline to object to or exclude yourself from the Discover Home Loans class action settlement is July 24, 2017.

Who’s Eligible

You are a Class Member of the Discover Home Loans settlement if DHL purchased your contact information from a third-party lead generator and used the information to make at least one non-emergency call between June 1, 2012 and July 31, 2015 using an automatic telephone dialing system or artificial prerecorded voice to promote goods or services, or to make more than one call within a 12-month period to a phone number registered on the National Do Not Call Registry.

Potential Award

$25 – $50 per claim (estimated)

The actual amount each claimant will receive depends on the total number of timely and valid Claim Forms filed.
