Progressive Michigan Insurance Co. and Progressive Marathon Insurance Co. will pay $61 million to resolve claims they failed to include certain fees in total loss payments.
The Progressive Michigan settlement benefits individuals insured under a Progressive Marathon Automobile Insurance Policy in Michigan who made a first-party claim for physical damage or theft to their vehicle(s) and received a total loss claim payment between July 18, 2013, and July 22, 2024.
The settlement also benefits individuals insured under a Progressive Michigan Automobile Insurance Policy in Michigan who made a first-party claim for physical damage or theft to their vehicle(s) and received a total loss claim payment between July 18, 2016, and July 22, 2024.
According to the class action lawsuit, Progressive breached the terms of its Michigan policies by failing to include sales tax, certificates of title fees and vehicle registration transfer fees in total loss payments. Plaintiffs argue their total loss settlements should have included compensation for these fees based on their policies’ terms.
Progressive is an insurance company with subsidiaries such as Progressive Michigan Insurance Co. and Progressive Marathon Insurance Co. that serve specific regions or industries.
The Michigan Progressive companies have not admitted any wrongdoing but agreed to pay $61 million to resolve the total loss class action lawsuit.
Under the terms of the Progressive Michigan settlement, class members can receive a proportional cash payment based on the amount they allegedly should have received for sales tax, certificates of title fees and vehicle registration transfer fees. Payment amounts will vary depending on how many class members file claims and the amount deducted for fees and expenses.
The exclusion and objection deadline is Oct. 22, 2024.
The final approval hearing for the settlement is scheduled for Nov. 21, 2024.
To receive settlement benefits, class members must submit a valid claim form by Dec. 6, 2024.
