California Wells Fargo bank managers have secured a $12.7 million settlement in a wage and hour class action lawsuit.
Current and former Wells Fargo bank managers who worked in California between Jan. 7, 2007 and Jan. 12, 2017 may qualify for a settlement payout.
This settlement arises out of litigation that began in March 2012. Plaintiffs alleged that Wells Fargo committed several violations of California labor law against its Level 1 and 2 Store Managers.
The plaintiffs claim Wells Fargo misclassified these Store Managers as being exempt from California and federal laws that require a higher rate of overtime pay for certain kinds of employees. They allege Wells Fargo failed to provide required meal and rest breaks and failed to pay these managers at an overtime rate for overtime hours.
The plaintiffs also claim Wells Fargo failed to promptly pay the wages of employees who quit or were discharged, failed to provide accurate wage statements, and violated California’s Unfair Competition Law. They also raise a claim for penalties under the California Private Attorneys General Act, or PAGA.
In August 2012, these multiple Wells Fargo lawsuits were consolidated into a single Judicial Counsel Coordinated Proceeding, or JCCP.
Wells Fargo continues to deny the plaintiffs’ allegations. The settlement does not require Wells Fargo to admit any fault.
The total amount of the Wells Fargo bank managers’ settlement is more than $12.7 million. After deductions for PAGA penalties, attorneys’ fees, administration costs, and awards for the Class representatives, the remaining amount to be distributed among Class Members is estimated at about $8.4 million.
Who’s Eligible
The Wells Fargo settlement covers two Classes of persons who worked as Wells Fargo Store Managers in California:
- All Store Managers who worked at a Level 1 Wells Fargo Store in California between Jan. 7, 2007 and Jan. 12, 2017; and
- All Store Managers who worked at a Level 2 Wells Fargo Store in California between Jan. 7, 2007 and Nov. 1, 2013.
Potential Award
Varies.
Qualified claimants will be entitled to a portion of the settlement amount determined by each claimant’s number of weeks worked during the Class Period in relation to the total number of such workweeks for all Class Members.
Qualified claimants employed on or after March 23, 2013 will be entitled to a pro rata share of the PAGA penalty fund after payment of $7,500 to the Labor and Workforce Development Agency.
Any remaining settlement funds not validly claimed by Class Members will be distributed proportionally among qualified claimants.
