Plaintiffs have secured nearly $2.9Â million to settle a TCPA class action lawsuit against Caliber Home Loans.
If you received an automated cell phone call from Caliber Home Loans on or after July 9, 2011 and did not consent to being contacted that way, you may qualify to receive a payment under terms of this settlement.
Plaintiff Rebecca Ashack initiated this TCPA class action lawsuit. Ashack alleges Caliber Home Loans made numerous calls to her cell phone in an attempt to collect a debt that had already been discharged in bankruptcy. She claims she received dozens of such calls even though she informed Caliber Home Loans that she did not consent to be contacted that way.
The Telephone Consumer Protection Act is a federal law that restricts how businesses can make unsolicited contact via phone, fax, or text message. Generally, callers are prohibited from making contact using an automated dialing system or an artificial or prerecorded voice unless they get prior express consent from the called party.
Each contact that violates the TCPA can subject the caller to as much as $1,500 in statutory damages.
Under terms of the Caliber Home Loans TCPA settlement, Caliber will pay $2,895,000 into a settlement fund. Payments will be distributed among qualifying Class Members who make a valid claim.
Caliber Home Loans is also required to change its telemarketing practices so that it will avoid using an automated dialing system to place calls to cell phone numbers without obtaining permission first.
