Everlywell and Natalist have agreed to pay $5 million to resolve a class action lawsuit claiming they violated consumer privacy laws by using tracking pixels on their websites.
The Everlywell settlement benefits consumers who purchased a product or service from the Everlywell or Natalist websites between April 2019 and Dec. 3, 2024.
There are two subclasses in the settlement — one for consumers who purchased sensitive test kits and other products such as tests for sexually transmitted infections, and another for consumers who purchased other test kits and products not included in the first subclass.
Everlywell is a health testing company that sells at-home tests for a variety of conditions. Natalist is a reproductive health company that sells pregnancy and ovulation tests, prenatal vitamins and other products.
The two companies have not admitted wrongdoing but agreed to the $5 million class action settlement to resolve these allegations.
The Everlywell and Natalist class action lawsuit claimed the companies violated consumer privacy laws by using tracking pixels on their websites that shared consumer data with third parties such as Meta and Google without obtaining the required consent from website visitors.
The plaintiffs say they were harmed by the companies’ alleged failure to protect their privacy. The Everlywell and Natalist class action lawsuit claims Everlywell and Natalist violated the Illinois Biometric Information Privacy Act (BIPA) and the California Consumer Privacy Act (CCPA).
Under the terms of the Everlywell settlement, class members can receive a cash payment based on their subclass.
The sensitive test subclass settlement fund is $2.64 million, while the non-sensitive test subclass fund is $2.36 million. Payments will vary depending on the number of claims filed in each subclass.
The deadline for exclusion and objection is March 19, 2025.
The final approval hearing for the Everlywell and Natalist tracking pixels settlement is scheduled for April 29, 2025.
In order to receive a settlement payment, class members must submit a valid claim form by March 19, 2025.

Individuals who used Everlywell or Natalist websites to purchase sensitive or non-sensitive test kits between April 2019 and Dec. 3, 2024.
