L’Occitane store class action settlement

Consumers who made a credit card purchase at a L’Occitane retail store in California between 2011 and 2013 can receive a Merchandise Certificate worth up to $12.50 from a proposed class action lawsuit settlement. The deadline to file a claim is Dec. 17, 2013.

The L’Occitane store settlement resolves a class action lawsuit (Owen v. L’Occitane Inc.) that alleges the retail locations operated by L’Occitane Inc. in California violated state law by requesting and recording personal identification information (physical addresses, email addresses, telephone numbers, zip codes, and other information) from its customers who paid for merchandise using a credit card.

L’Occitane denies any wrongdoing and any liability, but has agreed to a class action settlement to resolve the litigation.

Under the proposed settlement, L’Occitane will provide a Merchandise Certificate worth $12.50 off any merchandise purchase, subject to certain terms, redeemable at L’Occitane stores physically located within California.

Those eligible to participate in the L’Occitane class action settlement include anyone who used a credit card to make a purchase at a California L’Occitane store between Sept. 9, 2011, and Oct. 4, 2013, and had their personal identification information, including but not limited to postal address, email address, telephone number and/or ZIP Code, requested and recorded by a L’Occitane employee.

Class Members who received a notice by email or postcard that says they do not need to complete a Claim Form to receive a Merchandise Certificate will receive it automatically if the class action settlement is approved.

If you did not receive a notice by email or postcard, you must send in a Claim Form to qualify to receive a Merchandise Certificate. The deadline to submit a claim is Dec. 17, 2013. Claim filing instructions are below.

The Merchandise Certificate will be emailed within 35 days of the Final Effective Date of the settlement. A Final Fairness Hearing will be held Jan. 8, 2014.
