Several major grocery sore chains have agreed to pay $5.95 million to resolve claims they violated the federal Telephone Consumer Protection Act (TCPA) by sending unsolicited text messages to consumers.

The class action settlement benefits individuals who received two or more unsolicited text messages from Albertsons Companies, Star Markets Company, and/or Safeway, including their affiliates and subsidiaries, within a 12-month period after making a request to stop receiving further messages.

Plaintiffs in the class action lawsuit claim Albertsons, Safeway and Star Markets sent unsolicited text messages to consumers without their consent. These messages allegedly violated the TCPA, which requires businesses to get express written consent from consumers before sending unsolicited texts.

The grocery store companies have not admitted any wrongdoing but agreed to a $5.95 million settlement to resolve the TCPA class action lawsuit.

Under the terms of the Albertsons and Safeway class action settlement, class members can receive an equal share of the net settlement fund. Exact payment amounts will vary depending on the number of participating class members, but each class member is estimated to receive at least $100.

The deadline for exclusion and objection is Sept. 10, 2025.

The final approval hearing for the Safeway and Albertsons settlement is scheduled for Oct. 3, 2025.

To receive a settlement payment, class members must submit a valid claim form by Sept. 10, 2025.


Who’s Eligible

The settlement benefits individuals who received two or more unsolicited text messages and/or telemarketing calls from Albertsons, Star Markets Company Inc. and Safeway Inc. and their affiliates and subsidiaries between June 1, 2023, and the date of preliminary approval of the settlement and who received those messages after making a request to stop further messages.
