A $4 million Incode Technologies Inc. class action settlement resolves allegations the company violated Illinois’ biometric privacy law by collecting individuals’ biometric data without proper consent.

The Incode Technologies settlement benefits individuals who uploaded a selfie and photo ID to any application, software or website an Incode Technologies customer operated between Nov. 11, 2018, and Aug. 5, 2024, without first signing an Illinois’ Biometric Information Privacy Act disclosure.

The BIPA class action lawsuit alleges Incode Technologies collected individuals’ biometric data without complying with regulations. Illinois consumers who uploaded their selfies and photo IDs were not aware Incode Technologies collected their biometric data due to a lack of notice and disclosures, the plaintiffs contend.

Incode Technologies provides identity verification software that uses facial recognition for certain apps and websites, allowing consumers to upload a selfie and a photo ID for identity verification.

Incode hasn’t admitted any wrongdoing but agreed to pay $4 million to resolve the BIPA class action lawsuit.

Under the terms of the Incode Technologies settlement, class members can receive a pro rata share of the net settlement fund. These payments will vary depending on the number of claims submitted, but payments are estimated to be between $65 and $240.

The exclusion and objection deadline is Nov. 18, 2024.

The final approval hearing for the settlement is scheduled for Nov. 27, 2024.

To receive settlement payments, class members must submit a valid claim form by Nov. 25, 2024.
