A $7.5 million class action lawsuit settlement has been reached with consumers who received unsolicited text message advertisements containing web addresses or links leading directly or indirectly to www.Auto-Price-Finder.com. If you received a text message containing one of the links listed below, you may be eligible to claim up to $100 cash from the class action settlement.
The auto text settlement will resolve a class action lawsuit (Woodman v. ADP Dealer Services Inc., et al.) alleging that the text messages violated the federal Telephone Consumer Protection Act (TCPA). The TCPA prohibits companies from sending unsolicited text messages to consumers or calling their cell phones using an auto-dialer or pre-recorded message.
Violating the TCPA carries stiff fines and penalties. Consumers who believe they have been victims of a TCPA violation can receive significant compensation. Learn more here.
The defendants in the Auto text class action lawsuit settlement deny any wrongdoing but have agreed to establish a $7.5 million class action lawsuit settlement fund to resolve the litigation.
Class Members of the auto text settlement include all persons who received any text message that contained one of the following web addresses (URLs) or links leading to www.Auto-Price-Finder.com and who did not provide prior express consent for such a call:
www.Auto-Price-Finder.com
www.hiddencarprices.com
www.secretcardeals.mobi
www.secretcardeals.mobile
www.autofindnow.com
www.autodealfinder.com
www.autodealfinder.com.llhf.net
www.privatecarprices.com
www.hiddenautodeals.com
www.carpricethis.com
Examples of such text messages include, but are not limited to:
- Need a New Car? See which dealers may offer discounts & clearance pricing. Go to http://www.autodealfinder.com.llhf.net for free Service. It’s fast and easy!
- Your friend just sent you a great deal on a car! Instant quote. Goto http://hiddencarprices.com/?p=3072203565 and enter promo code 2390 to view now!
If you qualify, you may be eligible to receive a cash payment of up to $100, or up to $15, depending upon whether you are able to provide sufficient documentation showing that you received an applicable text message. Such proof could include, for example, a telephone bill containing a record that a text message was received from one of the telephone numbers listed above. If, in the Settlement Administrator’s view, the proof you submitted is insufficient, the Settlement Administrator may contact you to ask for additional information. If you cannot provide sufficient verification, you still may receive up to $15. You may only make one claim per wireless account holder.
Payments may be reduced on a pro rata basis if the number of approved claims exceeds the amount of money in the Settlement Fund.
The only way to receive a cash award from the auto text class action settlement is to submit a valid Claim Form by November 11, 2013.
Checks will be mailed within 60-90 days after the settlement has been finally approved and/or after any appeals have been resolved. A Fairness Hearing is scheduled for November 4, 2013.
UPDATE: Viewers are reporting to Top Class Actions that they received settlement checks in the mail valued at $15, starting in early February 2014.
