nelnet call recording class action lawsuit

Student loan servicer Nelnet has agreed to settle a class action lawsuit alleging it illegally recorded telephone calls without notifying the recipient. If you received a telephone call from Nelnet that was recorded without your authorization, you may be eligible to receive payment from the Nelnet class action settlement.

The Nelnet call recording lawsuit was filed by plaintiff Than Zaw, who alleged Nelnet called him regarding a family member’s debt. Zaw alleges Nelnet recorded the calls without notifying him and that he had never consented to having phone calls recorded by Nelnet. His class action lawsuit asserts claims under California’s Invasion of Privacy Law and Fair Debt Collection Practices Act.

Nelnet denies the allegations but has agreed to a class action settlement, which was preliminarily approved last month. Nelnet has agreed to pay nearly $1.2 million to settle the class action lawsuit and avoid the expense and uncertainty of ongoing litigation.

Who’s Eligible

Class Members of the Nelnet call recording settlement include anyone who received a telephone call from Nelnet while in the state of California that was recorded and/or monitored by Nelnet between Dec. 18, 2011 and Aug. 4, 2014.

Potential Award

To be determined. Class Members who submit valid and timely Claim Forms will receive a pro rata share of the Nelnet class action settlement fund. The actual payment amount will be determined based on how many claims are filed.

Proof of Purchase

Class Members must provide the approximate date of and the telephone number that received the call from Nelnet.

    Does anyone know if there is a lawsuit active for lending practices? I just got off the phone with a Nelnet representative that confirmed my worries. Nelnet charges interest daily, and then applies it to the principal. The very next say they charge you interest on your interest.
