Guess text spam settlement

A settlement has been proposed in a class action lawsuit alleging Guess? Inc. sent text messages in violation of the Telephone Consumer Protection Act.

If you received a text message from or on behalf of Guess between Oct. 16, 2013 and Nov. 8, 2016, you may be entitled to compensation from the TCPA class action settlement.

In 2014, plaintiff Farideh Haghayeghi of California filed the text message spam class action lawsuit, which alleges Guess sent text messages without first obtaining the consent of the recipients in violation of the TCPA.

Haghayeghi asserts she received multiple text messages on her cell phone from Guess or its agents. These text messages were advertisements offering discounts and other promotions at Guess stores and at the Guess website, the TCPA class action lawsuit alleges.

According to the Guess class action lawsuit, these text messages were placed using an automatic telephone dialing system which has the capacity to dial numbers randomly or sequentially. The TCPA prohibits the use of automatic telephone dialing systems to send text messages, Haghayeghi asserts.

Further, Haghayeghi maintains that she never provided her prior express consent to receive unsolicited text messages from Guess. The TCPA prohibits companies from making unsolicited calls or texts to consumers who have not provided their express consent to receive such communications, unless they have an established business relationship.

According to the Guess class action lawsuit, text spam is especially annoying to consumers because cell phones immediately alert the recipient of new text messages, which is disruptive if the text message is unwanted.

Text messages may also cost the recipient money, because many cell phone users pay their wireless service providers for each text message received or incur a usage allocation deduction to their text messaging plan.

Guess denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of trial.

If you would like to object to or exclude yourself from the Guess TCPA class action settlement, you must do so no later than Mar. 10, 2017.

Who’s Eligible

Class Members of the Guess TCPA settlement include: “All persons who received a text message from or on behalf of Guess between October 16, 2013 and November 8, 2016, inclusive.”

Potential Award

$15 – $30

Class Members who submit timely and valid Claim Forms may choose to receive either a cash payment of $15 or a $30 voucher to be used to purchase merchandise from Guess.
