Nissan North America Inc. has agreed to settle a class action lawsuit alleging it failed to disclose an alleged risk and/or pay for repairs for engine damage related to loosened power valve screws in some of its Pathfinder, Sentra and Altima vehicles.
If your Nissan vehicle experienced engine damage due to a loose power valve screw, you may be entitled to a cash payment from the Nissan class action settlement.
According to the Nissan class action lawsuit, power valve screws, which are located near the top of the engine on the intake manifold, could loosen and get sucked into the engine and cause engine damage.
When the power valve screw got sucked into a vehicle’s engine, the check engine light would likely have illuminated. In addition, power loss while driving or unstable engine idling may have occurred, and engine repair was likely required.
The plaintiffs alleged that the Nisan power valve screw defect can lead to engine failure and that it poses a risk to personal safety. The Nissan class action lawsuit asserted claims for breach of express warranty, breach of implied warranty, unjust enrichment, fraudulent concealment, violation of the California Consumer Legal Remedies Act and violation of the California Unfair Competition Law.
Nissan denies all allegations of wrongdoing. However, the motor company has agreed to settle the power valve screw class action lawsuit to avoid the risk and expense of ongoing litigation.
If you would like to opt out of the Nissan power valve screw class action settlement, you must do so no later than Feb. 7, 2017. If you would like to object to the Nissan settlement, you must do so by June 14, 2017.
Who’s Eligible
Class Members of the Nissan settlement include current and former owners or lessees of 2001-2004 model year Nissan Pathfinder with a VQ35 engine or a 2002-2005 model year Nissan Altima or Nissan Sentra with a QR25 engine. To be classified as a Class Member, you must have purchased or leased the vehicle in California.
The Nissan settlement provides reimbursement for costs associated with repairs that were made due to a loose or detached power valve screw that occurred outside the factory warranty period of five years or 60,000 miles (whichever occurred first). The following three criteria must be met in order to obtain reimbursement from the Nissan class action settlement:
- The engine damage or failure must have occurred when the vehicle was (i) more than five years in-service or the odometer registered more than 60,000 miles, whichever occurred first, and (ii) less than 12 years in-service and less than 120,000 miles on the odometer;
- If the repairs were previously paid for by Nissan (under the warranty, as part of Nissan’s Voluntary Service Campaign or by Nissan’s goodwill), reimbursement is not available.
- Documentation must be provided to show the issue and the repair, date of the diagnosis and repair, and the mileage at the time of diagnosis and repair.
Potential Award
Up to $3,000.
Nissan will reimburse Class Members for the cost paid to repair the engine, subject to certain caps. The amount each Class Member is eligible to receive depends on a number of factors, including the type of vehicle, the vehicle’s age or mileage, and whether the vehicle had an engine repair or replacement. Proof of Purchase
Class Members must provide documentation about the service performed to fix the damage allegedly caused by the power valve screw defect. The documentation must show the issue diagnosis, the repair made, the date of the diagnosis and repair, and the mileage at the time of the diagnosis and repair.

I received a notice that I was denied because the mechanic didn’t write why the engine needed to be replaced.
Something in the mail from power value screw settlement, anyone else?
What kind of letter did you receive, I’m out of town so I don’t know what kind I got but I think it’s a denial letter from the front of it in my inform delivery.
A letter stating my claim was denied because for my particular model of car, to qualify for this settlement, i had to had a 2.5 cylinder engine and mine is a 1.8. Not the case for all models covered in the settlement but for mine it was. Though it wasnt clear in the notice i recieved to submit the claim. :( i figured it was something like that bc it was too soon to for them to be sending out checks. Probably a technicality on your part as well bc theyve addressed claims requesting further documentation months ago. But Good Luck

I’m in Cali and I bought my 2003 Altima brand new with 8 miles on it in December 2002 I had to replace 2 blew head gadgets and the had to replace with whole new engine
I’m in Georgia and bought my 2005 Altima in Tennessee. Am I eligible to sign up for the lawsuit?
