Alpha Gas and Electric TCPA Class Action Settlement

Alpha Gas and Electric LLC has agreed to settle a class action lawsuit alleging it made telemarketing calls to cell phones in violation of the Telephone Consumer Protection Act.

If you received a call on your cell phone from Alpha Gas between July 8, 2011 and Nov. 10, 2016 and you did not provide consent to receive calls from the company, you may be entitled to payment from the TCPA class action settlement.

The Alpha Gas class action lawsuit was filed in July 2015 by plaintiff Stewart Abramson, who claims that Alpha Gas made telemarketing calls to cell phone numbers in violation of the TCPA.

The Telephone Consumer Protection Act is a federal law that was implemented to protect consumers from annoying telemarketing calls.

The TCPA prohibits companies from placing robocalls, sending unsolicited text messages, calling or texting people who do not have a business relationship with the company, calling numbers on the Do Not Call registry, and other violations.

Consumers who have received calls, texts or faxes that were sent in violation of the TCPA may be able to claim between $500 and $1,500 per violation.

Alpha Gas denies any wrongdoing and maintains that it did not violate the TCPA. However, it has agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

Alpha Gas has agreed to pay $1.1 million to establish a TCPA settlement fund. The Alpha Gas class action settlement received preliminary approval on Nov. 10, 2016.

Class Members who would like to exclude themselves from or object to the Alpha Gas TCPA settlement must do so no later than Feb. 8, 2017.

Who’s Eligible

Class Members of the Alpha Gas TCPA settlement include anyone in the United States who, from July 8, 2011 through Nov. 10, 2016, received phone calls from Alpha Gas that used an automated telephone dialing system or prerecorded voice, or who did not provide consent to receive such calls (or were listed on the Do Not Call list).

Settlement payments will be distributed pro rata, based on the total number of timely and valid claims that are filed.
