Williamsbridge Restaurant Inc. d/b/a New Hawaii Sea Restaurant has agreed to settle a class action lawsuit over an alleged exposure to the hepatitis A virus (HAV).
If you consumed food or beverages at the New Hawaii Sea Restaurant in the Bronx, N.Y., between Sept. 7, 2013 and Sept. 19, 2013 (or if you were exposed to someone who had done so) and you obtained a blood test and immune globulin or HAV vaccine within 30 days after dining at the restaurant, you may be entitled to benefits from the class action settlement.
Plaintiff Teshieda A. Williams filed the hepatitis A class action lawsuit against New Hawaii Sea Restaurant on Nov. 8, 2013, in which she asserted claims for products liability, negligence and breach of warranty. She sought compensation for the costs she incurred form obtaining immune globulin immunization shots and hepatitis A vaccinations after she learned of the possible hepatitis A virus exposure at the New Hawaii Sea Restaurant.
The New Hawaii Sea Restaurant class action lawsuit seeks compensation for the cost of the shot, the value of time lost in order to obtain the shot, and the concern and anxiety experienced due to receiving the shot.
New Hawaii Sea Restaurant denies any wrongdoing but has agreed to pay $200,000 to settle the hepatitis A class action lawsuit. The settlement was preliminarily approved on Oct. 21, 2016.
If you would like to opt out of or object to the New Hawaii Sea Restaurant, you must do so no later than Dec. 16, 2016.
Who’s Eligible
Class Members of the New Hawaii Sea Restaurant settlement include anyone who consumed food or beverage at the New Hawaii Sea Restaurant located at 1475 Williamsbridge Road in the Bronx, N.Y., between Sept. 7, 2013 and Sept. 19, 2013 (or were exposed to someone who had done so), and subsequently obtained a blood test and immune globulin (IG) or HAV vaccination shot within 30 days of dining at the restaurant.
NOTE: If you developed HAV infections after consuming food or drink at the New Hawaii Sea Restaurant during the Class Period, you are not eligible to participate in this hepatitis A class action settlement.
Potential Award
Class Members who submit a timely and valid Claim Form will receive an equal, pro-rata share of the $200,000 award.
Proof of Purchase
Class Members must provide the name and address of the facility at which they obtained the shot and certify under the penalty of perjury that the information provided in the Claim Form is correct.
