A preliminary $750,000 class action settlement has been reached between Golden Gate Hotel & Casino and a group of employees who allege they were not not compensated for all their overtime hours at the appropriate overtime rate or pay.
Plaintiffs Brandy Welch and Heather Blackmun brought the wage and hour class action lawsuit on behalf of themselves and other similarly-situated employees who worked for Golden Gate Hotel & Casino alleging that GGHC violated the Fair Labor Standards Act (FLSA) and state labor laws by failing to pay for attending mandatory pre-shift meetings, mandatory training sessions, as well as all wages and overtime owed upon termination.
Under the terms of the Golden Gate Hotel & Casino class action settlement, $750,000 will be paid by the company to settle this litigation, pending final court approval. From this fund, attorneys’ fees in the amount of $250,000, claims administration costs in the amount of $15,000, and Class Counsel’s out of pocket fees in the amount of $25,000 will be allocated.
Additionally, in consideration for their role in bringing the class action lawsuit, an incentive award in the amount of $10,000 will be paid to the Welch and Blackmun. The settlement also provides an enhancement award of $2,000 to two plaintiffs, Jessica Nunes and Mary Hernandez who filed a Consent to Sue and who provided a deposition in this case.
The remaining proposed net settlement payment of $436,000 will be dispersed to GGHC employees who worked for the company some time during the period of Dec. 17, 2009 through the present.
Golden Gate Hotel & Casino denies any allegation of wrongdoing and denies that it failed to pay all wages and overtime due, denies that it committed any violation of law, and denies that it acted improperly in any way but has agreed to settle the wage and hour claims in order to avoid further litigation and legal costs.
Who’s Eligible
There are two groups of individuals that comprise the Settlement Class: The FLSA Collective Class and the Nevada Class. These two Classes include the same employees but are separated because their claims are governed by different laws – federal for the FLSA Class and state for the Nevada Class.
Both Classes include all persons employed by Golden Gate Casino “who were non-union, non-exempt, hourly employees and who were eligible for overtime and incentives under GGC’s pay plans (Covered Position) and were employed in such a position between December 17, 2009 and the date of preliminary approval of the Settlement.”

The $436,000 net settlement fund will be dispersed proportionately to each eligible Class Member who submits a valid and timely claim. Individual payout amounts will be calculated “based on the number of hours the person worked in a Covered Position during the Class Period as compared with the total amount of hours worked by the entire class during that same period.”
