NCAA concussion settlement

A settlement has been reached in a class action lawsuit that alleges the National Collegiate Athletic Association failed to protect student athletes from concussions.

If you played an NCAA-sanctioned sport at an NCAA member school, you may be entitled to free medical screening and other benefits from the NCAA concussion class action settlement.

The NCAA concussion class action lawsuit was filed by former football and soccer players from NCAA member schools. They filed the concussion injury lawsuit on behalf of themselves and other current and former student-athletes at NCAA member schools.

Concussions or mild traumatic brain injuries can cause a number of symptoms, including rapid onset of cognitive impairment, amnesia, confusion, nausea, dizziness, headache, slowed reaction times, vision problems, sensitivity to light, and other symptoms.

Concussions do not always involve a loss of consciousness. If you suffered any of these symptoms while playing an NCAA sport, you may have suffered a concussion even if you were not formally diagnosed.

According to the NCAA class action lawsuit, even subconcussive hits may adversely affect brain function in ways that are similar to symptomatic concussions.

Although concussions are most commonly associated with football, they can occur in any sport. Head injuries can lead to Chronic Traumatic Encephalopathy (CTE), which can present with symptoms similar to those of Alzheimer’s disease. CTE can cause a person to suffer behavioral and mood changes in addition to cognitive difficulties.

The plaintiffs allege that the NCAA breached its duty to protect its student athletes by failing to implement appropriate rules regarding concussions and how to manage the risks of head injuries.

Their NCAA class action lawsuit sought medical monitoring for current and former NCAA student athletes. The plaintiffs also want the NCAA to make changes regarding their return-to-play guidelines for student athletes who suffered concussions or who exhibited symptoms of a concussion.

The NCAA denies all allegations of liability and wrongdoing. However, the association has agreed to settle the concussion class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

Under the terms of the proposed NCAA class action settlement, the NCAA will pay $70 million to resolve the litigation and pay for the Medical Monitoring Program.

The NCAA concussion class action settlement was preliminarily approved on July 15, 2016.

If you would like to object to or exclude yourself from the NCAA class action settlement, you must do so no later than Mar. 10, 2017.

Who’s Eligible

Class Members of the NCAA settlement include NCAA student athletes who played an NCAA-sanctioned sport at an NCAA school at any time prior to July 15, 2016.

NOTE: To be a member of the Medical Monitoring Class, you do not need to have been diagnosed with a concussion.

Potential Award

Class Members may be eligible to participate in a Medical Monitoring Program. If you have had any concussion symptoms after receiving a blow or jolt to the head, you may complete a Screening Questionnaire to determine whether you qualify for a Medical Evaluation designed to assess your post-concussion symptoms.

The Medical Monitoring Program will last 50 years from the effective date of the NCAA concussion class action settlement.

NOTE: The Medical Monitoring Program will not begin until the NCAA concussion class action settlement receives final approval by the court and any appeals are dismissed.

N/A. Class Members may complete a Screening Questionnaire to determine whether they are eligible to participate in the Medical Monitoring Program.

    I don’t think my daughter qualifies but I am interested in finding out who would be libel because she suffered a severe concussion in the school yard many years ago and now suffers from TMJ because her jaw is out of whack due to this injury I have had a lot of out of pocket expenses because TMJ is not a covered medical expense can anyone point me in a direction to help with this issue?
