Kovitz Shifrin Nesbit PC has agreed to settle several class action lawsuits that accuse the company of violating the Fair Debt Collection Practices Act. The FDCPA is a federal law that was designed to eliminate abusive debt collection practices and provide legal protection to consumers.

If you received a 30-Day Notice and Demand sent by Kovitz Shifrin Nesbit at an Illinois address between May 27, 2012 and Sept. 16, 2016, you may be entitled to payment from the debt collection class action settlement.

Plaintiffs Janice McCarter, Krystyna Scehura, Amy Lill and Christopher Wojdelko allege KSN sent them confusing letters related to their alleged failure to pay condominium assessments.

According to the FDCPA class action lawsuit, KSN’s initial communication with them included complicated language regarding the right of KSN to demand payment within 30 days and the right of the plaintiffs to a 30-day window within which to dispute the debt.

The plaintiffs also assert that KSN misrepresented the amount of the alleged debt they owed as well as the amount of time they had to pay the full amount.

KSN denies that it engaged in any wrongdoing but has agreed to pay $290,000 to settle the FDCPA class action lawsuit. The settlement was preliminarily approved on Sept. 16, 2016.

If you would like to exclude yourself from or object to the FDCPA class action settlement, you must do so no later than Dec. 5, 2016.

Who’s Eligible

Class Members include anyone who, between May 27, 2012 and Sept. 16, 2016, was sent a 30-Day Notice and Demand by KSN at an Illinois address.

Potential Award

Up to $1,000.

The amount each claimant will receive depends on the total number of timely and valid Claim Forms filed.
