Arshon Silicon Technology TCPA Fax Class Action Settlement

A settlement has been proposed in a class action lawsuit alleging Arshon Silicon Technology Inc. and Seyed-Maziar Hosseini violated the Telephone Consumer Protection Act (TCPA) by sending fax advertisements without the recipients’ prior express consent and which did not contain the required opt-out notice.

If you received a fax advertisement on behalf of the defendants between Apr. 24, 2011 and May 24, 2016 and you did not consent to receive the faxes, you may be entitled to compensation from the TCPA class action settlement.

Plaintiff Connector Castings Inc. filed the fax spam class action lawsuit against Arshon and Hosseini in April 2015, claiming the defendants violated the TCPA by sending fax advertisements that did not contain the required opt-out notice.

Further, the plaintiff alleges the faxes were sent without first obtaining the consent of the recipients.

The Telephone Consumer Protection Act is a federal law that protects consumers from telemarketing and other types of unsolicited advertisements. Companies that violate the TCPA may be liable for fines ranging from $500 to $1,500 per violation.

The defendants deny the allegations and maintain that they did not send fax advertisements without the consent of the recipients and without the required opt-out notice. Although they deny violating the TCPA, they have agreed to settle the TCPA class action lawsuit to avoid the expense, burden and uncertainty of continued litigation.

Who’s Eligible

You are a Class Member of the Arshon TCPA settlement if:

• You are a U.S. resident and you subscribed to a fax number which, between Apr. 24, 2011 and May 24, 2016, received a fax message advertising property, goods or services that were sent by or on behalf of Arshon Silicon Technology Inc. and/or Seyed-Maziar Hosseini
• You did not provide prior express consent or invitation to receive such faxed advertisements
• You either did not have an established business relationship with the defendants or the faxed advertisement did not display a clear and conspicuous opt-out notice or lacked a phone or fax number for sending the opt-out request

Potential Award

$47.35 – $1,500 per fax, depending on the total number of approved claims. Qualified claimants will receive a minimum payment of $47.35 for each faxed advertisement, up to a maximum of $1,500 per faxed advertisement.

Proof of Purchase

Class Members must provide the fax number to which the advertisements were sent as well as information about the entity or individual who subscribed to the fax number.
