Silver-Reign-Settlement

A proposed $500,000 wage and hour settlement has been reached between dancers and the Silver Reign Gentlemen’s Club in Los Angeles, California.

In April 2014, plaintiff “Kelley” initiated the wage and hour class action lawsuit under her stage name against Giant Ventures Inc., doing business as Silver Reign in the Superior Court of California, County of Los Angeles.

“Kelley” alleges that Silver Reign incorrectly classified all dancers as independent contractors rather than as employees.

The wage and hour lawsuit claims that, as a result of this incorrect classification, dancers were denied payment of overtime compensation, minimum wage, and reimbursement of uniform costs.

The plaintiff also claimed that dancers were not provided with meal breaks or premium compensation when meal breaks were missed, and that they were not furnished with accurate itemized wage statements.

Additionally, the lawsuit alleged that dancers were required to pay unlawful dance or stage fees, and were also required to pay a portion of their tips (including dance fees) to Silver Reign.

“Kelley” asserts that by engaging in these practices, Silver Reign violated California Business and Professions Code and various state labor laws.

Under the terms of the preliminary Silver Reign Dancers settlement, Silver Reign will pay $500,000 to resolve claims.

Out of this fund, Silver Reign will pay settlement administration costs, attorneys’ fees, plaintiff incentive awards.

Following these court-approved deductions, at least 50 percent of the net settlement funds will be dispersed on a proportional basis to each Class Member who submits a valid and timely Claim Form in an amount that is equal to (i) that Class Member’s total number of Work Weeks (ii) divided by the aggregate number of Work Weeks of all participating Class Members during the Class Period (iii) multiplied by the Net Settlement Amount.

Silver Reign denied and continues to deny all of the material allegations in the California wage and hour class action lawsuit.

Class Members who wish to object to the terms of the settlement must do so by Oct. 7, 2016.  Those who wish to be excluded from the settlement must do so by Nov. 7, 2016.

Who’s Eligible

Under the terms of the Silver Reign dancers class action lawsuit settlement, Class Members include all persons who, at any time between Apr. 25, 2010 and July 11, 2016, performed live nude, semi-nude and/or bikini dance entertainment at the Silver Reign Gentlemen’s Club located at 11908 Mississippi Avenue in Los Angeles.

The amount of your settlement payment will be based upon the number of weeks that you danced at Silver Reign, located at 11908 Mississippi Avenue in Los Angeles, between Apr. 25, 2010, and July 11, 2016.

      The final hearing is scheduled for 1/9/2017. Claims will not be paid until after the final hearing takes place, and the settlement receives final approval from the court. Once this occurs, there is a 30 day period in which appeals can be filed. Please keep checking Top Class Actions for updates.
