HealthSouth class action settlement

A settlement has been reached in a class action lawsuit alleging HealthSouth Corporation (and affiliated entities) concealed that one of its doctors had a long-term addiction to narcotics that caused him to be incompetent to render medical services.

If you were treated at Arthroscopic & Laser Surgery Center of San Diego LP (or any affiliated entities); SHC San Diego Inc.; HealthSouth Corporation; and/or if you received any surgery or treatment from Gary Losse MD at any time between Jan. 1, 1996 and Dec. 15, 2000, you may be entitled to compensation from the class action settlement.

If approved, this settlement will resolve a class action lawsuit filed in March 2003 by plaintiffs Tim Carroll, Anna Good and Paula Hamma. They accuse the defendants of violating California law by failing to disclose to the public that Gary Losse MD was incompetent to render medical services because of an alleged long-term addiction to narcotics.

The defendants deny that they violated the law but they have agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The HealthSouth class action settlement was preliminarily approved on May 6, 2016.

If you would like to opt out of or object to the HealthSouth class action settlement, you must do so no later than Oct. 25, 2016.

Who’s Eligible

Class Members include anyone who was a patient and received treatment at any of the following facilities between Jan. 1, 1996 and Dec. 15, 2000:

  • Arthroscopic & Laser Surgery Center of San Diego LP (and all affiliated entities)
  • SHC San Diego Inc.
  • HealthSouth Corporation at the HealthSouth Sports Medicine and Rehabilitation Center (formerly located at 5471 Kearny Villa Road, Suite 202 in San Diego)
Potential Award

Up to $10,000.

According to the settlement documents, 94 percent of the $5 million Net Settlement Fund will be distributed equally among claimants who received treatment by Gary Losse MD at Arthroscopic & Laser Surgery Center of San Diego. Claimants who fall into this category are expected to receive between $5,000 and $10,000.

Three percent of the Net Settlement Fund will be divided among claimants who received treatments at Arthroscopic & Laser Surgery of San Diego from a physician other than Gary Losse MD. Claimants who fall into this category are expected to receive between $200 and $500.

The remaining three percent of the Net Settlement Fund will be divided equally among claimants who received rehabilitation treatment at the HealthSouth Sports Medicine Center that was formerly located on Kearny Villa Road. Claimants who fall into this category are expected to receive between $50 and $200.

Class Members are asked to provide any copies of supporting documents (such as medical records) when submitting a Claim Form. NOTE: The Settlement Administrator may contact claimants for more information.
