KB Home has agreed to pay $6.5 million to the Florida Office of the Attorney General over allegations it failed to make certain disclosures to homebuyers regarding the construction of their homes and improperly denied warranty coverage to certain homeowners.
If you own a home in Florida that was built by KB Home, you may be entitled to benefits from this settlement.
The settlement will resolve a lawsuit filed by the Florida Office of the Attorney General in February 2016. The KB Home lawsuit asserts KB Home has built approximately 27,000 homes in Florida since it entered the home building market in the state in 2001.
The KB Home lawsuit accuses KB Home of failing to disclose that its homes were not built in accordance with applicable building codes. Close to 1,700 homes built by KB home in Florida have reportedly needed repairs due to water intrusion related to construction defects, according to the KB Home lawsuit.
The KB Home lawsuit also accuses KB Home of adopting a policy of refusing repairs for homeowners who purchased a home from a short sale or from a bank after a foreclosure proceeding.
Under the terms of the settlement, KB Home has agreed to make improvements to its home construction, such as using Tyvek stucco wrap instead of generic house wrap, using vinyl stucco accessories instead of metal, and using a Sherwin Williams two-coat paint system to paint the exterior of its homes.
KB Home has also agreed to obtain additional training for its employees and contractors from stucco industry experts.
Who’s Eligible
Your home may be eligible for repairs if you currently own a home built by KB Home in Florida, and the original buyer of the home purchased the home from KB Home after April 17, 2005, and the home has a stucco crack or delaminated stucco.

Proof of Purchase

Our home was built by KB Homes in 2020. We are experiencing major interior water intrusion. On 29 Sep 2022, after hurricane Ian passed through my neighborhood, master bedroom carpet near window (next to walk in closet) was drenched with water. Same for walk in closet. Windowsill had no evidence of water. On 10 Nov 2022, after hurricane Nicole , master bedroom carpet near window (next to walk in closet) was drenched with water. Same for walk in closet. This should not be happening to our home which is only two years old. Is this a foundation problem? Is there a history of water intrusion through the walls, foundation, or flooring with KB homes? Will KB homes fix this water intrusion problem?
We have the same problems with stucco cracks we were not notified of this claims settlement why is that our neighbors filed but did not tell us about it that’s wrong

I also notice large cracks to my property. I did not receive any information on the problem. House owners should have be notified. I want to take it further. This is not right to not inform people. Please can I have some information.
I’m just now noticing issues with my stucco and did some research on the internet about KB’s stucco. My house is 15 years old and is cracking and the stucco is grumbling off. I saw the deadline was 8/2017 but why wasn’t anything sent to kB home owners letting them know of this?

I wish that the attorney’s would look into the homes that have the same issue, in California. I live in one and we are constantly dealing with leaking water in our windows.
