California Lorna Jane customers who asked to redeem the balance of a gift card that was less than $10 for cash, and were denied that request by a store employee, could benefit from a class action settlement.
The Lorna Jane class action settlement resolves allegations that the sportswear retailer violated California state law by denying customer requests for a cash payout, when their gift card balance dropped below $10.
According to the settlement website, the agreement to settle was reached after both parties participated in mediation. The Court did not decide if either side was right, but found that the settlement was fair, adequate and reasonable.
Lorna Jane has agreed to the following settlement terms:
- To fully comply with Civil Code section 1749.5 in all of its California locations
- Update employee manuals to include information regarding this state law
- Hold at least one training session for Lorna Jane employees for the purpose of reviewing company policies on gift card redemption and how to comply with California’s gift card law
- Post a notice in an employee-only area for two years stating that “California law requires that a gift card must be redeemed for cash, upon a customer’s request, when the gift card balance falls below $10.00”
- For one year, post a notice visible to California customers that gift cards with less than $10 are redeemable for cash
- On its “terms and conditions” webpage, publish information about California’s gift card law
- Perform internal audits of compliance twice a year, for two years
In addition to these terms, Lorna Jane will also award a $9.99 store voucher to Class Members who say they threw out a gift card with less than $10 because they were told it could not be redeemed for cash.
Who’s Eligible
Class Members include all California consumers who “(1) possess a Lorna Jane gift card which has a balance of less than $10.00, or (2) possessed such a gift card between September 2, 2011 through April 6, 2016, and were informed by a Lorna Jane employee in California that it could not be redeemed for cash.”
Potential Award
$9.99 store voucher.
Lorna Jane settlement Class Members who file a valid claim will receive a store voucher for $9.99 that can be used at any Lorna Jane California locations.

No proof of purchase is required for this settlement, however Class Members must submit a valid Claim Form and declare under penalty of perjury that all the information is true and correct.

Mine showed up today via email.. However it is for $10, not $9.99.
It says “Attached to this email/notice is the Lorna Jane voucher valued at $10.00, which can be used at any Lorna Jane location in California and may be redeemed for cash”.
Can it still be redeemed for cash since it is not under $10(law says under $10, then company must redeem for cash when customer asks)?
Received mine today for 10.00 in an email..got to find a store….
