Garmin-Forerunner-610

Garmin Ltd. agreed to settle a class action lawsuit over allegations that its Forerunner 610 watch and watchband are defective.

Plaintiff Andrea Katz filed the Garmin class action lawsuit after claiming that she bought the sport watch as a present for her husband who competes in distance races but the product did not live up to its advertising claims.

According to Katz, Garmin marketed the Forerunner 610 watch as “not just a pretty face… [but] stands up to rain [and] sweat.” However, the wristband allegedly fell apart on three separate occasions and needed to be repaired.

Katz says that Garmin replaced the watchband twice before recommending that the couple buy a velcro watchband at their own expense to fix the issue.

The Garmin class action lawsuit alleged the company made false advertising claims about the sport watch including that the device could be used to help consumers “be the best [they] can be in preparation for a marathon.”

Katz claims that her husband was engaging in that exact activity when the plastic wristband fell apart on multiple occasions.

Garmin denies the allegations but agreed to settle the class action lawsuit to avoid the cost and risk of going to trial.

Those Class Members who wish to opt out of or object to the class action settlement must do so no later than Oct. 14, 2016.

Who’s Eligible

Class Members include all U.S. residents who purchased or owned a Garmin Forerunner 610 watch between April 2011 and July 2014.

“If you are a Class Member who has already purchased a replacement watchband to address the alleged design defect, then you are a member of Subclass 1. If you are a Class Member who paid to repair your watchband or watch as a result of the watchband detaching from the watch face, then you are a member of Subclass 2. Members of these Subclasses may be entitled to additional Settlement Benefits.”

Potential Award

Varies.

All Class Members, regardless if they file a Claim Form, will automatically receive a 12-month Consumer Limited Warranty following the final approval of this settlement.

Class Members who file a claim for the Garmin settlement may receive a repair or replacement of their watchband or watch at no cost.

Subclass 1 Class Members may be eligible for either:

  • Actual cost of the replacement watchband if the replacement band was purchased from Garmin or an authorized Garmin retailer
  • Up to $50 if the replacement watchband was purchased from a third party and was not a Garmin manufactured watchband

Subclass 2 Class Members may be eligible for either:

  • Actual cost of the repair of the replacement band if done by Garmin
  • Actual cost of the repair up to $75 if repaired by a third party

In order to receive benefit from the Garmin class action settlement Class Members must submit a Claim Form no later than Sept. 28, 2016 and sign under penalty of perjury that all the information is true.

Depending on what Settlement benefit you are asking to receive, you may be required to submit supporting documentation.

    I received a replacement watch band in the mail. It is a black band, looks like men’s sizing. My watch is white with turquoise trim, and I need a smaller band. I called Garmin they told me they can only replace the bands with black bands and the size they mailed. This doesn’t do me any good. I am already out the money to replace the band twice from this faulty band and now I have a black large band I will never be able to use. This doesn’t make much sense that Garmin just mailed bands, this doesn’t benefit me or Garmin. Now I am more disappointed than before. Doesn’t seem like Garmin cares about their customers.
