A settlement has been reached between Global Marketing Research Services Inc. and a Class of consumers alleging the company made calls to cell phones without express prior consent from consumers, and thus violated the Telephone Consumer Protection Act (TCPA).
GMRS denies that its calls violated any laws and maintains that TCPA is unconstitutional as it applies in the current situation.
GMRS also states that its calls were political in nature and were made to phone numbers collected from voter registration lists where consumers listed their cell phone numbers.
In this case, the Court has not made a decision as to who is right or wrong, and both GMRS and the plaintiffs have agreed to a settlement. By reaching a settlement, the parties avoid the risks, uncertainties and expenses that are associated with further litigation.
The total settlement amount GMRS has agreed to is $10Â million.
This settlement will cover the cost of the Settlement Administrator to notify the Class, attorneys’ fees and costs, and Class Representative awards.
The remaining funds will be split among eligible Class Members who will receive up to $15, depending on the total number of valid claims filed.
The settlement pertains to three separate class action lawsuits all filed against Global Marketing Research Services Inc., including the primary Martin v. GMRS and two similar cases also filed in federal court as listed below.
Additionally, the settlement also allows consumers to remove their cell phone numbers from the GMRS database to eliminate any future calls made by GMRS or on behalf of the company.
Consumers wishing to opt out of or object to the settlement must do so by July 15, 2016.
Who’s Eligible
Consumers who received a cellphone call from GMRS between Aug. 11, 2010 and Dec. 31, 2014 are eligible to join the class action settlement.
