A proposed class action settlement has been reached with Worthington Ford and Worthington Ford Imports (doing business as Mercedes Benz of Anchorage).

In a class action lawsuit filed against the vehicle dealerships, the consumers alleged that the companies violated Alaska law by failing to include the Dealer Fees that were advertised in the price of the vehicles.

With respect to Worthington Ford, the plaintiffs also alleged that the dealership failed to properly disclose that it had received Dealer Reserve Fees from lenders after assisting customers with secure financing from third-party lenders.

A judge has not decided in favor of either party, as the settlement was reached as part of a compromise by both sides. Worthington has continued to deny any wrongdoing and claims it properly disclosed relevant fees according to all applicable laws.

The parties agreed to the settlement in order to avoid the risks and uncertainty of proceeding to trial. Both sides have agreed the settlement is reasonable and fair and serves the best interests of all parties.

Who’s Eligible

For the Worthington Ford Settlement:

If you purchased a motor vehicle from Worthington Ford in Anchorage between July 15, 2011 and January 11, 2016, you are a member of at least one of the three Settlement Classes defined as follows:

  • Doc Fee Settlement Class – All customers of Worthington Ford that paid a Doc Fee identified on sale documents as ‘doc fee,’ ‘documentary fee,’ ‘document preparation fee,’ or ‘administrative fee’ between July 15, 2011 and July 31, 2012 (date of statutory amendment).
  • Post Amendment Doc Fee Settlement Class – All customers of Worthington Ford that paid a Doc Fee identified on sale documents as ‘doc fee,’ ‘documentary Fee,’ ‘document preparation fee,’ or ‘administrative fee’ between August 1, 2012 (date of statutory amendment) and January 11, 2016.
  • Dealer Reserve Settlement Class – All customers of Worthington Ford who had the interest rate on their loan increased by Worthington above the ‘Buy Rate’ provided by the lender between July 15, 2011 and January 11, 2016.”

For the Worthington Imports/Mercedes Benz Settlement

“If you purchased a used motor vehicle from Worthington Imports in Anchorage between October 9, 2012 and January 11, 2016, you are a member of the Settlement Class defined as follows:

  • Doc Fee Settlement Class – All customers of Worthington Imports (dba Mercedes Benz of Anchorage) that purchased a used vehicle and paid a Doc Fee identified on sale documents as ‘doc fee,’ ‘documentary fee,’ ‘document preparation fee,’ or ‘administrative fee’ between October 9, 2012 and January 11, 2016.”
Potential Award

Varies.

The potential awards for the Worthington Ford Classes include:

  1. Doc Fee Settlement Class: $125 cash AND $150 voucher (or $50 cash payment for residents living more than 100 miles from Anchorage)
  2. Post-Amendment Doc Fee Settlement Class: $75 cash AND $75 voucher (or $20 cash payment for residents living more than 100 miles from Anchorage)
  3. Doc Fee Settlement Class: $50 cash AND $150 voucher (or $35 cash payment for residents living more than 100 miles from Anchorage)

Eligible class members may belong to more than one class and may receive benefits from multiple classes.

The potential awards for the Worthington Imports Class includes:

  1. $150 cash AND $150 voucher (or $50 cash payment for residents living more than 100 miles from Anchorage)

No proof of purchase is required, but Class Members must submit a Claim Form no later than July 20, 2016.
