California Sunglass Hut customers who asked to redeem the balance of a gift card that was less than $10 for cash, and were denied that request, may benefit from a class action settlement.

According to the settlement website, Sunglass Hut Trading LLC agreed to settle a California class action that accused the company of violating state law by refusing customers a cash payout when their gift card balance fell below $10.

Under the terms of the settlement, Sunglass Hut has agreed to the following:

  • To comply with Civil Code section 1749.5 in all California locations
  • Review and update written policies and procedures
  • Make sure employee manuals state: “California law requires that a gift card must be redeemed for cash, upon a customer’s request, when the gift card balance falls below $10.00”
  • Perform training sessions for employees, and require them to acknowledge that they understand the gift card redemption policy
  • Verbally instruct new California Sunglass Hut workers of the state law
    Post notices in “employee-only” areas that remind Sunglass Hut workers of this state law
  • On their “Terms and Conditions” webpage, publish information regarding California’s gift card law

In addition to these terms, Sunglass Hut has also agreed to reimburse Class Members, who threw away a gift card with a remaining balance of less than $10 because they were told by an employee that it couldn’t be redeemed for cash, a gift card valued at $9.99.

This gift card can be used at all Sunglass Hut locations within the State of California, without an additional purchase requirement.

Who’s Eligible

Class Members include “All consumers in California who (1) possess a Sunglass Hut gift card which has a balance of less than $10.00, or (2) possessed such a gift card from February 17, 2011 to February 23, 2016, but disposed of it upon being informed by a Sunglass Hut employee in California that it could not be redeemed for cash.”

$9.99 Gift Card

Class Members of the Sunglass Hut class action settlement will receive a gift card for $9.99 that can be used at any Sunglass Hut locations in California.
