A settlement has been reached in a class action lawsuit that alleges Labor Ready Southwest Inc. violated California wage and hour laws by failing to pay minimum wage and overtime as well as other violations.
If you worked for Labor Ready as a temporary worker in California at any time between April 30, 2005 and April 30, 2013, you may be entitled to compensation from the wage and hour class action settlement.
If approved, the Labor Ready settlement will resolve a class action lawsuit that alleges Labor Ready violated California wage and hour laws and unfair competition laws by failing to pay workers minimum wage and overtime; failing to provide adequate meal and/or rest periods; failing to reimburse for work-related expenses; failing to provide compliant wage statements; and failing to pay timely wages upon a worker’s termination.
The plaintiffs also allege that workers were charged fees for cashing their checks by using Cash Dispensing Machines in Labor Ready’s branch offices.
Labor Ready denies the allegations and asserts that it did not violate the law. However, Labor Ready has agreed to pay $4.5 million to settle the wage and hour class action lawsuit and avoid the expense and uncertainty associated with ongoing litigation.
In addition to providing cash benefits to Class Members who file timely and valid claims, Labor Ready has also agreed to fix many of the issues that were listed in the wage and hour class action lawsuit.
For example, the company will notify workers of a job by text message instead of requiring them to check in at hiring halls. Further, Labor Ready has also reportedly stopped using the fee-charging Cash Dispensing Machines.
Class Members who wish to opt out of the Labor Ready settlement must do so no later than July 11, 2016. Objections must be filed with the court no later than Aug. 22, 2016.
Who’s Eligible
Class Members of the wage and hour settlement include all individuals who worked in California for Labor Ready as temporary workers at any time between April 30, 2005 and April 30, 2013.
Potential Award
Up to $25.
Class Members who used Cash Dispensing Machines in Labor Ready’s branch offices will be entitled to a payment of $25. Class Members who did not use the Cash Dispensing Machines are eligible to receive a payment of $10 from the Labor Ready settlement.

I worked for labor ready in 2011 2012 13_14 on a prevailing wage job and only received min wage and I worked for 8 bucks an hr when wages were min 8:50 per hour up. Visalia CA under the manager Kearny
I am truly elegible for this Lawsuit, as I have received the Postcard; and waiting to be Compensated! $25 that is a Joke! Esp after Waking Up 3:30 am everyday just to wait in line to be assured a job; that in Most Cases never happened…Due to favoritism!

I’ve been calling the number on the post card. And I haven’t received a single return call yet. Nor have I received any compensation from this lawsuit. Is there someone I can call?
I also worked for labor ready I was given a check that was no good stater Bros in Rialto or grand terrace cashed it and then I got a notice that it never cleared I called labor ready numerous times and they assured me it would be taken care of. It never was .Most likely Stater Bros still have records. Also I sent in the post card due in July before the 11th haven’t heard from Allen ? since. To thank you
