A settlement has been proposed in a class action lawsuit alleging Merrill Lynch failed to pay interns minimum wage for the hours they worked, in violation of the New York Labor Law.
If you were an unpaid intern for Merrill Lynch between Aug. 29, 2008 and Jan. 31, 2013, you may be entitled to benefits from the unpaid internship class action settlement.
Plaintiff Brian Wong filed the minimum wage class action lawsuit against Merrill Lynch, seeking to recover allegedly unpaid minimum wages for himself and others who are similarly situated, as well as interest, attorneys’ fees, costs and other relief.
Merrill Lynch denies any wrongdoing and maintains that it has acted in accordance with the law at all times. However, Merrill Lynch has agreed to settle the unpaid intern class action lawsuit to avoid the burden, expense, inconvenience and uncertainty of ongoing litigation.
Under the terms of the class action settlement, Merrill Lynch will pay a total of $1.75 million to resolve the litigation. The Merrill Lynch settlement was preliminarily approved on Apr. 14, 2016.
Class Members who want to object to or opt out of the Merrill Lynch settlement must do so no later than Aug. 2, 2016.
Who’s Eligible
You are a Class Member of this proposed settlement if you were an unpaid intern for Merrill Lynch at any time between Aug. 29, 2008 and Jan. 31, 2013.
Potential Award
$500 for each unpaid internship performed for Merrill Lynch during the Class Period. Each Class Member’s share will be reduced by any payroll tax deductions that need to be withheld.
Proof of Purchase
In addition to submitting a Claim Form, claimants must also submit an IRS Form W-9 and a copy of their government-issued identification.

If you did not receive notice of this class action settlement, you have until Aug. 17, 2016 to file your Claim Form.
